STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trequiring payment of lawful money to employees.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Payment of Lawful Money to Employees.  Amend RSA 275:43, VII(e) to read as follows:

\t\t\t(e)(1)  Nothing in this paragraph modifies or affects any federal law regarding compensatory time off including the Fair Labor Standards Act of 1938, 29 U.S.C. section 207.  The purpose of this paragraph is to make compensatory time off available as set forth above under New Hampshire law and not to limit already existing rights and protection.  An employer shall provide compensatory time off under whichever statutory provision provides greater rights to employees.

\t\t\t\t(2)  Any bank or financial institution, including credit unions, demanding a check-cashing fee directly from the employee who does not have an account at such institution shall be guilty of theft by extortion under RSA 637:5.

\t\t\t(f)  The result of any payment by any of the methods indicated in subparagraphs (b), (c), (d), and/or (e) shall be as required in subparagraph I(a) for payment in "lawful money of the United States" upon the employee's claim for such lawful coin as defined in the federal or state constitution.

\t2  Effective Date.  This act shall take effect 60 days after its passage.
