STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study issues relating to pre-existing districts withdrawing from a cooperative school district.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t225:1  New Subdivision; Commission to Study Issues Relating to Pre-Existing Districts Withdrawing from a Cooperative School District.  Amend RSA 195 by inserting after section 31 the following new subdivision:

Commission to Study Issues Relating to Pre-Existing Districts

Withdrawing from a Cooperative School District

\t195:32  Commission Established.

\t\tI.  There is established a commission to study issues related to pre-existing districts withdrawing from a cooperative school district.  The membership of the commission shall be as follows:

\t\t\t(a)  Three members from the house of representatives, 2 of whom shall serve on the education committee, and one of whom shall serve on the finance committee, appointed by the speaker of the house of representatives.

\t\t\t(b)  One member from the senate education committee, appointed by the senate president.

\t\t\t(c)  The commissioner of the department of education, or designee.

\t\t\t(d)  The commissioner of the department of revenue administration, or designee.

\t\t\t(e)  Two school board members from cooperative school districts, appointed by the governor.

\t\t\t(f)  Two superintendents from cooperative school districts, appointed by the governor.

\t\t\t(g)  One member from the New Hampshire School Administrators Association, appointed by that association.

\t\t\t(h)  One member from the New Hampshire School Boards Association, appointed by that association.

\t\t\t(i)  One member from the New Hampshire Council of School Attorneys, appointed by that association.

\t\t\t(j)  One member of the public who has experience with the process of withdrawing from a cooperative school district, appointed by the chairperson of the house education committee.

\t\t\t(k)  One member of the public who has experience with the process of withdrawing from a cooperative school district, appointed by the chairperson of the senate education committee.

\t\tII.  The commission shall study issues relating to the withdrawal of pre-existing districts from their cooperative school district, including:

\t\t\t(a)  The procedure for withdrawal, including the procedure for both initiating a withdrawal study and the procedure for approval of any proposed withdrawal plan.

\t\t\t(b)  How assets are determined, valued, and apportioned among the pre-existing districts.

\t\t\t(c)  The nature and scope of the withdrawal plan created according to RSA 195:26, including the liability of the withdrawing pre-existing district pursuant to RSA 195:27 and the disposition of any property pursuant to RSA 195:28.  

\t\t\t(d)  Any other issue which the commission deems relevant to the objective of the study.

\t\tIII.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tIV.  The department of education and house committee research staff shall provide clerical, administrative, and research services to the commission as may be needed.

\t\tV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 30 days of the effective date of this section.  Seven members of the commission shall constitute a quorum.

\t\tVI.  The commission shall file an interim report on or before January 1, 2017, and shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2017.

\t225:2  Repeal. RSA 195:32, relative to the commission to study issues relating to pre-existing districts withdrawing from a cooperative school district, is repealed.

\t225:3  Effective Date.

\t\tI.  Section 2 of this act shall take effect November 1, 2017.

\t\tII.  The remainder of this act shall take effect upon its passage.
