STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trequiring the pharmacy board to adopt protocols governing the dispensing of naloxone hydrochloride.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; Pharmacists and Pharmacies; Dispensing of Naloxone.  Amend RSA 318 by inserting after section 16-c the following new section:

\t318:16-d  Protocols Required for Access to Naloxone.  

\t\tI.  The board shall adopt standardized protocols to allow licensed pharmacists to directly dispense or otherwise furnish naloxone hydrochloride to patients who do not hold a prescription.

\t\tII.  Notwithstanding any provision of law to the contrary, a licensed pharmacist may dispense or otherwise furnish naloxone hydrochloride to any person in accordance with the protocols established in paragraph I.

\t2  Applicability.  The pharmacy board shall adopt the standardized protocols required under RSA 318:16-d, I within 3 months of the effective date of this act.

\t3  Effective Date.  This act shall take effect 60 days after its passage.
