STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a committee to study education savings accounts for families of special needs students.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Committee Established.  There is established a committee to study education savings accounts (ESAs) for families of special needs students.

\t2  Membership and Compensation.  

\t\tI.  The members of the committee shall be as follows:

\t\t\t(a)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t(b)  Two members of the senate, appointed by the president of the senate.

\t\tII.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

\t3  Duties.  The committee shall:

\t\tI.  Study the following:

\t\t\t(a)  The implementation of ESAs in New Hampshire.  Such study shall include the funding mechanism for the ESAs such as using the business tax credit or state education funding.  If state funding is used, such study shall consider whether a percentage shall remain with the local district for administration.

\t\t\t(b)  Who shall administer and manage the ESA program.

\t\t\t(c)  Whether the program shall be limited to families with special needs students and what qualifications would be necessary to participate in the program.

\t\t\t(d)  What shall constitute allowable expenses for special needs students using the ESAs.

\t\t\t(e)  Features of ESA programs established in other states and recommend which features shall be included in the New Hampshire ESA program.

\t\t\t(f)  Any other matter the committee deems relevant to its objective.

\t\tII.  Act as a resource to the house and senate education committees on ESA legislation, including making recommendations about appropriate terminology and methodology for such legislation.

\t\tIII.  Solicit input from any individual or organization with relevant information and expertise.

\t4  Chairperson; Quorum.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named house member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Four members of the committee shall constitute a quorum.

\t5  Report.  The committee shall submit an interim report of its findings and any recommendations for proposed legislation on or before November 1, 2016, and a final report on or before September 1, 2017, to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library.

\t6  Effective Date.  This act shall take effect upon its passage.
