STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study septic sludge spreading.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Subdivision; Septic Sludge Spreading Study Commission.  Amend RSA 149-M by inserting after section 60 the following new subdivision:

Septic Sludge Spreading Study Commission

\t149-M:61  Septic Sludge Spreading Study Commission Established.  There is established a commission to study septic sludge spreading.

\t\tI.  The members of the commission shall be as follows:

\t\t\t(a)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t(b)  Three members of the senate, appointed by the president of the senate.

\t\t\t(c)  The commissioner of the department of environmental services, or designee.  

\t\t\t(d)  A soil scientist, appointed by the president of the university of New Hampshire.

\t\t\t(e)  A waste management professional specializing in the operation of solid waste treatment facilities, appointed by the New England Section of the Air and Waste Management Association.

\t\t\t(f)  A septage hauler, appointed by the New Hampshire Association of Septage Haulers.

\t\tII.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tIII.  The commission shall study the rules and regulations relative to septic sludge spreading and consider the necessity of regulations of septic sludge spreading.

\t\tIV.  The members of the study commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Four members of the commission shall constitute a quorum.

\t\tV.  The commission  shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2016.

\t2  Repeal.  RSA 149-M:61, relative to septic sludge spreading study commission, is repealed.

\t3  Effective Date.  

\t\tI.  Section  2 of this act shall take effect November 1, 2016.

\t\tII.  The remainder of this act shall take effect upon its passage.
