\tThis bill establishes a commission to study the feasibility of suspending Medicaid benefits when a person enters a state institution or county correctional facility instead of terminating such benefits.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study the termination of Medicaid benefits when a person enters certain state institutions or county correctional facilities.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Subdivision; Commission to Study the Termination of Medicaid Benefits

When a Person Enters a State Institution or County Correctional Facility.  Amend RSA 126-A by inserting after section 68 the following new subdivision:

\t126-A:69  Commission to Study the Termination of Medicaid Benefits When a Person Enters a State Institution or County Correctional Facility.

\t\tI.  There is established a commission to study the termination of Medicaid benefits when a person enters a state institution or county correctional facility.

\t\t\t(a)  The members of the commission shall be as follows:

\t\t\t\t(1)  Three members of the house of representatives, 2 of whom shall be from the house health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.

\t\t\t\t(2)  One member of the senate, appointed by the president of the senate.

\t\t\t\t(3)  The insurance commissioner, or designee.

\t\t\t\t(4)  The commissioner of the department of health and human services, or designee.

\t\t\t\t(5)  The commissioner of the department of corrections, or designee.

\t\t\t\t(6)  The chief justice of the superior court, or designee.

\t\t\t\t(7)  A representative of the New Hampshire Hospital Association, appointed by the association.

\t\t\t\t(8)  A representative of the New Hampshire Medical Society, appointed by the society.

\t\t\t\t(9)  A county corrections superintendent, appointed by the governor.

\t\t\t\t(10)  A representative of Well Sense Health Plan, appointed by that association.

\t\t\t\t(11)  A representative of New Hampshire Health Families, appointed by that organization.

\t\t\t\t(12)  A representative of the National Alliance on Mental Illness, appointed by the alliance.

\t\t\t\t(13)  A representative of New Futures, appointed by that organization.

\t\t\t\t(14)  A representative of the New Hampshire Association of Counties, appointed by the association.

\t\t\t\t(15)   The chairperson of the governor's commission on alcohol and drug abuse prevention, intervention, and treatment, or designee.

\t\t\t\t(16)  A representative of the New Hampshire Psychiatric Society, appointed by the society.

\t\t\t\t(17)  One public member, appointed by the governor.

\t\t\t(b)  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tII.  The commission shall study the termination of Medicaid benefits when a person enters a state institution or county correctional facility.  The committee's study shall include, but not be limited to, whether it is feasible to suspend the Medicaid benefits until the person is released from the institution or facility.

\t\tIII.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Nine members of the commission shall constitute a quorum.

\t\tIV.  The commission shall make a report with its findings and any recommendations for proposed legislation on or before November 1, 2016 to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library.

\t2  Repeal.  RSA 126-A:69, relative to the commission to study the termination of Medicaid benefits when a person enters a state institution or county correctional facility, is repealed.

\t3  Effective Date.

\t\tI.  Section 2 of this act shall take effect November 1, 2016.

\t\tII.  The remainder of this act shall take effect upon its passage.
