STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study processes to resolve right-to-know complaints.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; Commission to Study Processes to Resolve Right-to-Know Complaints.  Amend RSA 91-A by inserting after section 8 the following new section:

\t91-A:8-a  Commission to Study Processes to Resolve Right-to-Know Complaints.

\t\tI.  There is established a commission to study processes to resolve right-to-know complaints.

\t\t\t(a)  The members of the commission shall be as follows:

\t\t\t\t(1)  One member of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t\t(2)  One member of the senate, appointed by the president of the senate.

\t\t\t\t(3)  The attorney general, or designee.

\t\t\t\t(4)  Two public members, one of whom shall be a member of Right To Know New Hampshire, appointed by the governor.

\t\t\t(b)  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tII.(a)  The commission shall study processes to resolve right-to-know complaints.  Specifically, the commission's study shall include, but not be limited to, creating an ongoing board or commission to adjudicate citizen right-to-know complaints.

\t\t\t(b)  The commission may solicit information from any person or entity the commission deems relevant to its study.

\t\tIII.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Three members of the commission shall constitute a quorum.

\t\tIV.  The commission shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2016.

\t2  Repeal.  RSA 91-A:8-a, establishing a commission to study processes to resolve right-to-know complaints, is repealed.

\t3  Effective Date.  

\t\tI.  Section  2 of this act shall take effect November 1, 2016.

\t\tII.  The remainder of this act shall take effect upon its passage.
