STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to mandatory vaccines.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Findings.  The general court hereby finds:

\t\tI.  It is known and well-documented in medical science that those who have been recently vaccinated with a live-virus vaccine may present a health risk to others, especially to those who are ill or otherwise have compromised immunity.

\t\tII.  Those who profit from vaccine production, sales, distribution, and administration are protected by federal law from liability for all harm caused by vaccines, including permanent disability and death.

\t\tIII.  The evidence is clear that vaccines are not always protective and some vaccines carry a higher risk of failure than others.

\t\tIV.  The evidence is clear that some persons are harmed by vaccination.

\t\tV.  There is no consensus that vaccination with the influenza vaccine will protect those vaccinated and no consensus that influenza vaccination will protect others who have contact with those vaccinated.

\t\tVI.  It is a moral necessity to protect the right to bodily integrity for all persons without force or coercion to submit to medical procedures that carry risk.

\t2  New Subdivision; Mandatory Vaccines.  Amend RSA 275 by inserting after section 75 the following new subdivision:

Mandatory Vaccines

\t275:76  Employer Vaccine Policies.  Any employer which has a policy relative to the administration of vaccines shall not require an employee to receive such vaccine.  For those employees who are vaccinated in accordance with any employer vaccine policy, workers' compensation coverage shall be provided for any illness, disability, or death which occurs as a result of the vaccine.  The employer shall keep a statistical record as to adverse events following vaccination, including deaths and shall make such information available to the public, upon request.  Those persons who administer vaccines shall also report adverse events in connection with the vaccine policy to the federal Vaccine Adverse Event Reporting System (VAERS) as required by federal law.  Medical decision making relative to vaccination shall not be coerced by threats or policies to restrict employment, compensation, insurance coverage, education, or medical treatment.

\t275:77  Penalty.  Any vaccine provider violating the provisions of this subdivision shall be subject to a civil penalty, to be imposed by the labor commissioner in accordance with the procedures under RSA 273:11-a.  In addition, failure to report adverse events shall result in a suspension of vaccination privileges for 30 days for the first offense, 180 days for the second offense and permanent suspension of such privileges for the third offense.  

\t3  Effective Date.  This act shall take effect upon its passage.
