STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT\trequiring the department of safety to establish a database cataloging certain law enforcement activities.
Be it Enacted by the Senate and House of Representatives in General Court convened:
\t1 New Section; Database of Law Enforcement Activities. Amend RSA 106-B by inserting after section 14-b the following new section:
\t106-B:14-c Database of Law Enforcement Activities.
\t\tI. The department of safety shall establish and maintain a database which is accessible to the public through the department's website and which catalogs the following state and local law enforcement activities, including the location of, number of parties involved in, and monetary cost of each activity:
\t\t\t(a) Swat raids.
\t\t\t(b) Bearcat deployments.
\t\t\t(c) Shootings by police officers.
\t\t\t(d) Tazings.
\t\t\t(e) Drone use.
\t\t\t(f) Civil asset forfeitures.
\t\tII. Each local law enforcement agency shall report any activities under subparagraphs I(a)-(f) to the department of safety on a monthly basis. The commissioner shall adopt rules to implement this reporting requirement.
\t2 New Subparagraph; Department of Safety; Rulemaking. Amend RSA 21-P:14, II by inserting after subparagraph (ee) the following new subparagraph:
\t\t\t(ff) The reporting requirement for local law enforcement agencies for purposes of the database of law enforcement activities established under RSA 106-B:14-c.
\t3 Effective Date. This act shall take effect 60 days after its passage.

AN ACT\trequiring the department of safety to establish a database cataloging certain law enforcement activities.
FISCAL IMPACT:
The Department of Safety and New Hampshire Municipal Association state this bill, as introduced, will increase state and local expenditures in FY 2017 and each year thereafter. There will be no impact on state, county, and local revenues or county expenses.
METHODOLOGY:
The Department of Safety states this bill requires it to establish a database cataloging certain state and local law enforcement activities. The database is required to be accessible to the public through the Department’s website and would include activities related to swat raids, bearcat deployments, shootings including officers, tazings, drone use, and civil asset forfeitures. Under this bill, local law enforcement agencies would be required to report such activities to the Department on a monthly basis, which may increase expenditures relative to potential usage of additional staffing. This bill would increase state expenditures by an indeterminable amount relative to the Department’s establishment, maintenance, and overall administration of the database.
The New Hampshire Municipal Association states the requirement for local law enforcement agencies to report certain activities on a monthly basis to the Department of Safety may increase staff needs and increase expenditures. The Association is not able to determine the impact on expenditures as it has no basis to make an estimate.
