STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\ttransferring the administration of the telecommunications accounting unit.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t147:1  State Government Telecommunication Services; Transfer From the Department of Safety to the Department of Information Technology.

\t\tI.  All of the functions, positions, powers, duties, responsibilities, and funding for the telecommunication services to state government, formerly authorized by RSA 21-P:48-a, II, to the division of emergency services and communications, department of safety shall be transferred to the department of information technology, effective July 1, 2016.  Such transfers shall include the transfer of all associated books, papers, records, personnel files, and equipment, including, but not limited to, work station and information technology equipment, and shall include the transfer of any unexpended appropriations for any of the foregoing, as well as any unexpended appropriations for salary/payroll, benefits, support costs, or any other costs associated with the transferred personnel of the division of emergency services and communications, department of safety related to telecommunication services to state government.

\t\tII.  All contracts, rules, statutory responsibilities, regulations, and procedures related to statewide telecommunication services to state government in effect, in operation, or adopted in the division of emergency services and communications, department of safety are transferred to the division of operations, department of information technology.

\t147:2  New Paragraphs; Duties of the Department of Information Technology.  Amend RSA 21-R:4 by inserting after paragraph XVIII the following new paragraphs:

\t\tXIX.  Providing telecommunications services to state government.

\t\tXX.  Adopting comprehensive and uniform standards, practices, procedures, instructions, and funding processes relative to statewide telephony services applicable to all state agencies.  The comprehensive and uniform requirements shall be in the form of a manual and shall be subject to the approval of the governor and council, but shall not be subject to the rulemaking requirements of RSA 541-A.

\t147:3  Department of Safety; Division of Emergency Services and Communications.  Amend RSA 21-P:48-a, II to read as follows:

\t\tII.  With the approval of the commissioner, the director may employ such necessary technical, clerical, stenographic, and other personnel, and may make such expenditures from state or federal funds as are or may be made available for purposes of emergency services and communications.  The director and other personnel of the division shall be provided with appropriate office space, furniture, equipment, supplies, stationery and printing, and funds for traveling and related expenses, in the same manner as provided for personnel of other state agencies.  With general oversight by the assistant commissioner, the director [shall provide telecommunications services to state government,] shall coordinate the activities of all organizations for emergency 911 telecommunications within the state, state and local, county, and private, and shall maintain liaison with and cooperate with police, fire, emergency medical, and sheriff's departments and emergency telecommunications organizations of other states and of the federal government.  The director shall have such additional duties, responsibilities, and authority authorized by applicable laws as may be prescribed by the commissioner.

\t147:4  Department of Safety; Statewide Telecommunications; Appropriation Reduced; FY 2017.  Amend the appropriation to the department of safety for statewide telecommunications, accounting unit 02-23-23-236510-1870, as inserted by 2015, 275, by striking out:

\t147:5  Department of Information Technology; Statewide Telecommunications; Supplemental Appropriation; FY 2017.  For the purpose of administering statewide telecommunications, the sum of $5,259,387 is hereby appropriated to the department of information technology in a separate accounting unit to be established by the department of administrative services, bureau of accounts, in the following classes, for the fiscal year ending June 30, 2017:

ORGANIZATION NOTES

* The department of information technology is authorized to assess a fair and equitable charge for telecommunications and core network services, equipment, and supplies.  Such charges shall be made against departmental or institutional appropriations upon request and delivery.  Funds arising from such charges shall be accounted for separately, and shall be continually appropriated to fund this account and for such purposes as may be approved by the governor and council.

\t147:6  Positions Transferred.  The following positions are transferred from the department of safety to the department of information technology: 10074 (accountant I); 10150 (technical support specialist II); 18020 (systems development specialist VI); 18430 (business systems analyst II); 30043 (technical support specialist III); 41158 (technical support specialist V); TMPPT4837 (technical support specialist I); TMPPT4838 (technical support specialist I); TMPPT2657 (telecommunications tech  II); and a temporary support specialist I position classified at labor grade 17.

\t147:7  Positions Abolished.  The following positions in the department of safety are hereby abolished at the close of business on June 30, 2016: position 10138 and  position 43659.

\t147:8  Department of Information Technology; Classified Position Established.  There is established in the department of information technology the classified position of information technology manager V.  The position shall be classified at labor grade 34.

\t147:9  Department of Administrative Services; Bureau of Accounting; Supplemental Appropriation.  In addition to any other sums appropriated to accounting unit 01-14-14-140510-1310-018, the sum of $25,000 is appropriated to the department of administrative services, bureau of accounting, for the fiscal year ending June 30, 2017, for overtime costs incurred by the bureau of accounting.  The sum shall be a charge against funds appropriated to the department of information technology, class 49 transfers to other agencies, in the accounting unit established by section 5 of this act.

\t147:10  Department of Administrative Services; Financial Data Management; Supplemental Appropriation.  In addition to any other sums appropriated to accounting unit 01-14-14-142010-1370-018, the sum of $50,000 is appropriated to the department of administrative services for the fiscal year ending June 30, 2017, for the purpose of funding overtime costs associated with financial data management.  The sum shall be a charge against funds appropriated to the department of information technology, class 49 transfers to other agencies, in the accounting unit established by section 5 of this act.

\t147:11  Administrative Procedure Act; Exemption from Rulemaking.  Amend RSA 541-A:21, I(gg) to read as follows:

\t\t\t(gg)  RSA [21-P:4, XV] 21-R:4, XX, relative to the telephony services manual developed by the department of [safety] information technology.

\t147:12  Repeal.  RSA 21-P:4, XV, relative to the department of safety's responsibility for statewide telephony services, is repealed.147:147:

\t147:13  Effective Date.  

\t\tI.  Section 7 of this act shall take effect June 30, 2016.

\t\tII.  The remainder of this act shall take effect July 1, 2016.
