STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to the age for purposes of compulsory education.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Truancy; Age Limit.  Amend RSA 189:35-a, I to read as follows:

\t\tI.  For the purposes of this subdivision, "truancy'' means an unexcused absence from school or class by a pupil 16 years of age or younger and "unexcused absence'' is an absence which has not been excused in accordance with RSA 189:34, II(a).

\t2  Age of Majority for Purposes of Compulsory Education.  Amend the introductory paragraph of RSA 193:1, I to read as follows:

\t\tI.  A parent of any child at least 6 years of age and under [18] 16 years of age shall cause such child to attend the public school to which the child is assigned in the child's resident district. Such child shall attend full time when such school is in session unless:

\t3  Age of Majority for Purposes of Compulsory Education.  Amend RSA 193:16 to read as follows:

\t193:16  Bylaws as to Nonattendance.  Districts may make bylaws, not repugnant to law, concerning habitual truants and children between the ages of 6 and [18] 16 years not attending school or who are not participating in an alternative learning plan under RSA 193:1, I(h), and to compel the attendance of such children at school; failure to comply with such bylaws shall constitute a violation for each offense.

\t4  Age of Majority for Purposes of Compulsory Education.  Amend RSA 193-A:1, I to read as follows:

\t\tI.  "Child'' means a child or children at least 6 years of age and under [18] 16 years of age who is a resident of New Hampshire.

\t5  Effective Date.  This act shall take effect 60 days after its passage.

AN ACT\trelative to the age for purposes of compulsory education.

 

 

FISCAL IMPACT:

The Department of Education states this bill, as introduced, may have an indeterminable impact on state and local revenues and expenditures.  There will be no impact on county revenues or expenditures.

 

METHODOLOGY:

The Department of Education states this bill lowers the age of compulsory education from 18 to 16.  The Department states it is unable to estimate this bill’s potential impact on student attendance and therefore cannot estimate its impact on state and local revenues or expenditures.
