STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to sanctuary cities.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Sections; Sanctuary City Prohibited.  Amend RSA 124 by inserting after section 14 the following new sections:

\t124:14-a  Definition; Sanctuary City.  "Sanctuary city" means any municipality that has adopted an ordinance stating that such municipality will not enforce federal immigration laws.

\t124:14-b  Sanctuary Cities Prohibited.  No municipality in the state shall adopt an ordinance declaring it to be a sanctuary city.

\t124:14-c  Penalty.  The state shall not distribute any federal aid to a municipality that violates RSA 124:14-b.

\t2  Effective Date.  This act shall take effect 60 days after its passage.

HB 1621-FN-LOCAL- FISCAL NOTE

 

AN ACT\trelative to sanctuary cities.

 

 

FISCAL IMPACT:

The Department of Transportation, Department of Safety, and Department of Education state this bill, as introduced, may increase state expenditures by an indeterminable amount and may have an indeterminable fiscal impact on local revenue in FY 2017 and each year thereafter.  There will be no fiscal impact to state and county revenue or county and local expenditures.  

 

METHODOLOGY:

The Department of Transportation states this bill prohibits a municipality from adopting an ordinance declaring it will not enforce federal immigration laws.  The state shall not distribute any federal aid to any municipality violating the prohibition.  To enforce this bill the Department would need to track municipalities in violation of this bill.  The Department does not currently track such information.  If a municipality was part of a proposed road construction project passing through multiple localities and had an ordinance declaring it would not enforce federal immigration laws, then the Department would need to revise its project scope.  Such a revision could result in an indeterminable cost or an incomplete project.  The Department identifies state funds as another option to complete a portion of such a project if federal funds were not available.  

       

The Department of Safety states this bill requires it to check local ordinances before passing federal funds to municipalities.  The cost is dependent upon the number of grants passed to municipalities.  The fiscal impact to municipalities is dependent upon whether they choose to establish an ordinance in violation of the prohibition in this bill.

 

The Department of Education states that to the extent municipalities choose to adopt an ordinance in violation of this bill, federal grants passed to the offending municipalities will decrease.   

 

The Department of Justice states this bill would have no fiscal impact on its operations.  If a municipality were to adopt an ordinance stating it will not enforce federal immigration laws then federal funds would be directed to another municipality.

 

The New Hampshire Municipal Association states it is not aware of any municipalities that have adopted ordinances stating they will not cooperate with federal law enforcement or immigration enforcement.  Consequently, the Association concludes this bill will have no fiscal impact.
