ANALYSIS

 

\tThis bill provides that rules adopted by the fish and game department for baiting shall allow persons with a disability to engage in baiting during any regular season in which baiting is permitted.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Fifteen

 

AN ACT\trelative to baiting for game birds and game animals by persons with a disability.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Fish and Game; Rulemaking; Baiting; Persons with a Disability.  Amend RSA 207:3-d, I to read as follows:

\t\tI.  The executive director shall adopt rules, pursuant to RSA 541-A, relative to the opening and closing of the season for the practice of baiting for coyote, furbearing animals, game birds, or game animals with the exception of gray squirrel, provided that such rules shall allow a person with a disability, as defined in RSA 206:15-d, to engage in the practice of baiting during any regular season for the taking of game birds or game animals in which baiting is permitted.

\t2  Fish and Game; Definition; Person with a Disability.  Amend RSA 206:15-d to read as follows:

\t206:15-d  Definition.  For the purposes of RSA 206:15-c and RSA 207:3-d, “person with a disability” means a person who by reason of a physical defect or infirmity permanently requires the use of special aids to enable him or her to [propel himself] take wildlife under the provisions of this title.

\t3  Effective Date.  This act shall take effect 60 days after its passage.
