STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Fifteen

 

AN ACT\testablishing breast cancer and pediatric cancer special number plates.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Subdivision; Breast Cancer and Pediatric Cancer Number Plates.  Amend RSA 261 by inserting after section 97-f the following new subdivision:

Breast Cancer and Pediatric Cancer Number Plates

\t261:97-g  Breast Cancer and Pediatric Cancer Number Plates.  The department shall issue breast cancer and pediatric cancer number plates upon receipt of an application meeting the requirements of RSA 261:97-i.  Breast cancer and pediatric cancer number plates shall have the same effect and be issued in the same manner as other number plates.  Breast cancer number plates shall display a pink ribbon and pediatric cancer number plates shall display a yellow ribbon.  Breast cancer and pediatric cancer number plates shall retain the “live free or die” logo.

\t261:97-h  Eligibility.  The department shall only accept an application for breast cancer and pediatric cancer number plates from an entity that is determined by the Internal Revenue Service to be a tax exempt organization pursuant to section 501(c)(3) of the Internal Revenue Code and registered with the attorney general.

\t261:97-i  Application.

\t\tI.  An application for breast cancer and pediatric cancer number plates shall provide:

\t\t\t(a)  Verification of the applicant’s eligibility under RSA 261:97-h.

\t\t\t(b)  Whether the applicant is applying for breast cancer or pediatric cancer number plates.

\t\t\t(c)  The owner’s name, date of birth, and vehicle registration information for at least 1,000 vehicles, which will be issued the initial breast cancer or pediatric cancer number plates in the applicant’s plate series.

\t\t\t(d)  Thirty dollars for each vehicle listed pursuant to subparagraph (c).

\t\t\t(e)  A statement that the applicant agrees to use all funds received by the applicant under this subparagraph in this state and for the benefit of New Hampshire residents.

\t\tII.  After successful submission of the application information under paragraph I, the applicant shall verify annually the applicant’s continuing eligibility.  Failure to verify eligibility shall result in the termination of the applicant’s plate series.

\t261:97-j  Issuance and Renewal; Fees.

\t\tI.(a)  The fee for breast cancer and pediatric cancer number plates shall be $30 per year per set, which shall be in addition to any other registration and number plate fees.  Plates issued for vehicles listed by the applicant under RSA 261:97-i, I(c) shall be exempt from this fee for the first year.

\t\t\t(b)  The department shall retain from fees collected under this chapter an amount as is necessary to recover production and administrative costs as approved by the fiscal committee of the general court.  The remaining funds shall be paid to the state treasurer and distributed to the applicable applicant entity.

\t\tII.  If the annual subscription to any breast cancer or pediatric cancer number plate series falls below 1,000 vehicles, the director may terminate the issuance of new plates for that series.

\t2  Effective Date.  This act shall take effect July 1, 2015.

HB 567-FN - FISCAL NOTE

 

AN ACT\testablishing breast cancer and pediatric cancer special number plates.

 

 

FISCAL IMPACT:

The Department of Safety states this bill, as introduced, will increase state restricted revenue by an indeterminable amount in FY 2016 and each fiscal year thereafter, increase state expenditures by $565,700 in FY 2016, and $3,000 in FY 2017 and each fiscal year thereafter; and increase local expenditures by an indeterminable amount in FY 2016.  There will be no fiscal impact on county and local revenue, or county expenditures.

 

METHODOLOGY:

The Department of Safety states this bill establishes breast cancer and pediatric cancer number plates for use as a funding mechanism by tax exempt organizations.  The proposed legislation requires a minimum issuance of 1,000 sets of plates per organization to be issued for an additional fee of $30 for each set, and specifies an annual renewal rate of $30 for each set of plates issued.  The bill requires the Department to obtain applicant information verifying the applicant’s initial eligibility, and to verify the applicant’s continued eligibility annually while providing the Department the option of discontinuing the issuance of additional plates if the annual renewal rate falls below 1,000 sets of plates per year.  Revenues derived from the issuance and renewal fees are to be retained by the Department to the extent necessary to recover production and administrative costs as approved by the fiscal committee, with the remainder being returned to the applicant for use “in this state and for the benefit of New Hampshire Residents”.  Assuming the issuance of 1,000 sets of plates in FY 2016, followed by the issuance of an additional 1,000 sets of plates in FY 2017, or one of each type of plate authorized, the Department states this bill would increase state restricted revenue by $30,000 in FY 2016 (1,000 x $30 per set issued), and $60,000 in FY 2017 and each fiscal year thereafter (issuance of initial plates and renewals).  However, the Department notes the addition of special number plate options has the potential to reduce the utilization of other special number plates whose revenue is otherwise dedicated, such as the Conservation Heritage and State Park plates.  The Department is unable to estimate to what extent, if any, the addition of the special plates authorized by this bill would negatively affect these other designated revenues.  

 

The Department estimates the initial costs associated with the establishment of two special number plates, including establishing the necessary policies and procedures for implementation and programming changes for information technology systems, to be $565,700 and states these costs would be incurred during FY 2016.  The Department states municipalities would also incur additional costs relative to implementation in FY 2016 but is unable to estimate those costs at this time.  The Department estimates subsequent administrative costs will increase state expenditures by $3,000 in FY 2017 and each fiscal year thereafter.  

 

The Department states the proposed legislation is unclear as to their ability to recover initial production costs not recovered in FY 2016.  The Department notes the division of motor vehicles is currently in the process of implementing a project to replace several systems including those associated with driver licensing, financial responsibility, auto dealer and inspection stations, and financial subsystems.  The Department states the diversion of resources necessary to establish and disburse the additional special plate could impede the Department’s ability meet its obligation to the vendor which could in turn, result in additional costs jeopardizing the Department’s ability to complete the project within its current appropriation.
