\tThis bill makes the failure to deliver home heating fuel in the winter, after the customer pays an arrearage or enters into a reasonable repayment plan, a violation of the consumer protection act.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Fifteen

 

AN ACT\trelative to home heating fuel deliveries in the winter.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Paragraph; Regulation of Business Practices for Consumer Protection; Acts Unlawful; Failure to Deliver Home Heating Fuel.  Amend RSA 358-A:2 by inserting after paragraph XVI the following new paragraph:

\t\tXVII.  Failing to deliver home heating fuel within a reasonable time, between the dates of November 15 and March 31, after the payment of an unpaid arrearage or deposit by cash, certified or cashier’s check, a government or community action agency guarantee, or after evidence of an agreement with a municipal welfare official, pursuant to RSA 165, to pay for the current delivery with the customer entering into a reasonable repayment plan with the home heating fuel provider for the unpaid arrearage or deposit.  For the purpose of this paragraph, a “reasonable repayment plan” shall consider, among other things, the size of the arrearage or deposit, the customer’s ability to pay, and the customer’s payment history.

\t2  Effective Date.  This act shall take effect upon its passage.
