\tThis bill expands the defense and indemnification provided under RSA 99-D to certain claims filed with and investigations by professional licensing boards, committees, and regulatory agencies.

 

\tThis bill was requested by the commission to study the expansion of defense and indemnification rights to certain state employees, established in 2015, 77 (SB 96).

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\texpanding the defense and indemnification provided under RSA 99-D to certain claims filed with and investigations by professional licensing boards, committees, and regulatory agencies.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; Complaints or Investigations Arising From Licensing Board, Committee, or Regulatory Agency Matters.  Amend RSA 99-D by inserting after section 10 the following new section:

\t99-D:11  Complaints or Investigations Arising From Licensing Board, Committee, or Regulatory Agency Matters.

\t\tI.  Without otherwise limiting or defining the sovereign immunity of the state and its agencies, this chapter shall apply to all complaints filed with or investigations by a professional licensing board, committee, or regulatory agency against any state officer, trustee, official, employee, member of the general court, or other person identified in RSA 99-D:2 when acting in the scope of such person's official elected, appointed, or state employment duty and not in a wanton or reckless manner.

\t\tII.  This section shall apply only to complaints or investigations arising out of incidents occurring on or after July 1, 2013.

\t2  Effective Date.  This act shall take effect upon its passage.
