STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study the planning functions of the office of energy and planning.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Subdivision; Commission to Study the Planning Functions of the Office of Energy and Planning.  Amend RSA 4-C by inserting after section 30 the following new subdivision:

Commission to Study the Planning Functions

 of the Office of Energy and Planning

\t4-C:31  Commission to Study the Planning Functions of the Office of Energy and Planning.

\t\tI.  There is established a commission to study the planning functions of the office of energy and planning.

\t\tII.  The members of the commission shall be as follows:

\t\t\t(a)  One member of the senate, appointed by the president of the senate.

\t\t\t(b)  Two members of the house of representatives, appointed by the speaker of the house of representatives, one of whom shall be a member of the house municipal and county government committee and one of whom shall be a member of the executive departments and administration committee.

\t\t\t(c)  The director of the office of energy and planning, or designee.

\t\t\t(d)  The commissioner of the department of resources and economic development, or designee.

\t\t\t(e)  The commissioner of the department of environmental services, or designee.

\t\t\t(f)  The commissioner of the department of transportation, or designee.

\t\t\t(g)  The director of the division of homeland security and emergency management, in the department of safety, or designee.

\t\t\t(h)  The director of the division of economic development, department of resources and economic development, or designee.

\t\t\t(i)  The executive director of the New Hampshire Municipal Association, or designee.

\t\t\t(j)  The president of the New Hampshire Planners Association, or designee.

\t\t\t(k)  The executive director of the New Hampshire housing finance authority, or designee.

\t\t\t(l)  Two members representing regional planning commissions, appointed by the governor, one of whom shall be from a metropolitan area, and one of whom shall be from a rural area.

\t\t\t(m)  One member of a city planning board or staff, appointed by the governor.

\t\t\t(n)  One member of a town planning board or staff, appointed by the governor.

\t\tIII.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tIV.  The commission shall study the current planning functions of the office of energy and planning.  The commission shall examine alternative methods of providing these and other planning functions, including, but not limited to, the establishment of a state planning commission and/or the creation of a separate office of state planning.  The commission may seek input from any individuals, agencies, or organizations it deems to be relevant.  The commission may make recommendations for future legislation.

\t\tV.  The members of the study commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named house member and shall be held within 45 days of the effective date of this section.  Eight members of the commission shall constitute a quorum.

\t\tVI.  The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2017.

\t2  Repeal.  RSA 4-C:31, relative to the commission to study the planning functions of the office of energy and planning, is repealed.

\t3  Effective Date.

\t\tI.  Section 2 of this act shall take effect November 1, 2017.

\t\tII.  The remainder of this act shall take effect upon its passage.
