STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a committee to study guardianship in New Hampshire.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t152:1  Committee Established.  There is established a committee to study guardianship in New Hampshire.

\t152:2  Membership and Compensation.

\t\tI.  The members of the committee shall be as follows:

\t\t\t(a)  One member of the senate, appointed by the president of the senate.

\t\t\t(b)  Four members of the house of representatives, one of whom shall be a member of the children and family law committee, 2 of whom shall be members of the judiciary committee, and one of whom shall be a member of the health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.

\t\tII.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

\t152:3  Duties.  The committee shall study guardianship in New Hampshire to determine:

\t\tI.  Whether guardians should be registered and licensed by the state.

\t\tII.  Who should have jurisdiction over guardians.

\t\tIII.  The number of guardians in New Hampshire and how the work of a private guardian differs from that of a public, court appointed guardian.

\t\tIV.  The requirements, if any, for someone to become a guardian.

\t\tV.  Whether New Hampshire should adopt, or adopt with amendment, the National Guardianship Association Standards of Practice.

\t152:4  Chairperson; Quorum.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the senate member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Three members of the committee shall constitute a quorum.

\t152:5  Report.  The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2016.

\t152:6  Effective Date.  This act shall take effect upon its passage.
