STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a committee to study private guardianship in New Hampshire.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Committee Established.  There is established a committee to study private guardianship in New Hampshire.

\t2  Membership and Compensation.

\t\tI.  The members of the committee shall be as follows:

\t\t\t(a)  One member of the senate, appointed by the president of the senate.

\t\t\t(b)  Four members of the house of representatives, 2 of whom shall be members of the children and family law committee, one of whom shall be a member of the judiciary committee, and one of whom shall be a member of the health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.

\t\tII.  Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.

\t3  Duties.  The committee shall study private guardianship in New Hampshire to determine:

\t\tI.  Should private guardians be registered and licensed by the state?

\t\tII.  Who should have jurisdiction over private guardians?

\t\tIII.  How many private guardians are working in New Hampshire and is their job substantially different from the job of public, court appointed guardians?

\t\tIV.  What are the requirements, if any, for someone to become a private guardian?

\t4  Chairperson; Quorum.  The members of the study committee shall elect a chairperson from among the members.  The first meeting of the committee shall be called by the first-named senate member.  The first meeting of the committee shall be held within 45 days of the effective date of this section.  Three members of the committee shall constitute a quorum.

\t5  Report.  The committee shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2016.

\t6  Effective Date.  This act shall take effect upon its passage.
