AMENDED ANALYSIS
This bill:
\tI. Adds the following positions to the unclassified salary schedule: administrator of the site evaluation committee, deputy commissioner of the liquor commission, deputy commissioner of the department of information technology, and executive director of the office of professional licensure and certification.
\tII. Changes the salary classification of the chairman of the liquor commission, executive assistant to the adult parole board, chief information security officer, commandant of the state veterans home, the deputy director of the division of motor vehicles, and the executive director of the judicial council.
\tIII. Clarifies when prior approval by the fiscal committee and governor and council is required for the liquor commissioner to transfer funds within accounting units.
\tIV. Makes appropriations to the department of corrections to purchase 6 full body scanners for use in state correctional facilities and to the department of justice to administer grants to counties to offset a portion of the cost of full body scanners for county correctional facilities.

\t3 Liquor Commission; Transfer of Funds Within Operating Budget. Amend RSA 176:16, V to read as follows:
\t\tV. The commissioner is authorized to transfer funds within and among all accounting units within the commission's operating budget and to create accounting units and expenditure classes as required and as the commissioner deems necessary and appropriate to address present or projected budget deficits, or to respond to changes in federal law, regulations, or programs, and otherwise as necessary for the efficient management of the liquor commission. Any individual transfer of $75,000 or more shall require prior approval of the fiscal committee of the general court and governor and council, and any determination of this prior approval requirement shall not be determined on a cumulative basis. The provisions of this section shall not be subject to RSA 9:16-a, RSA 9:17-a, and RSA 9:17-c.
\t4 Appropriation; Department of Corrections; Scanners for State Correctional Facilities. In addition to any other funds appropriated to the department of corrections, the sum of $1,110,000 for the fiscal year ending June 30, 2017 is hereby appropriated to the department for the purchase and installation of 6 full body security scanners in the state correctional facilities. Three of the scanners shall be installed in the state prison for men in Concord, 2 scanners shall be installed in the northern New Hampshire correctional facility in Berlin, and one scanner shall be installed in the new state prison for women. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
\t5 New Section; State Prisons; Security Screening. Amend RSA 622 by inserting after section 6 the following new section:
\t622:6-a Security Screening Required. All individuals entering a state correctional facility, including but not limited to visitors, state officials, employees, contractors, and vendors, shall be subject to a security screening using a full body security scanner. The full body security scanners shall be installed and operated in a manner that enables the detection of contraband but does not display or record an image of an individual's private body parts. With the exception of images that show contraband and are needed as evidence for prosecution, no image may be copied, duplicated, or retained for more than 24 hours.
\t6 Appropriation; Department of Justice; Scanners for County Correctional Facilities. In addition to any other funds appropriated to the department of justice, the sum of $740,000 for the fiscal year ending June 30, 2017 is hereby appropriated to the department for the purpose of providing grants to the counties for up to 50 percent of the cost of one full body scanner for each county correctional facility in New Hampshire that does not have such a scanner as of the effective date of this act. The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.
\t\tI. Section 3 of this act shall take effect upon its passage.
\t\tII. Sections 4, 5, and 6 of this act shall take effect July 1, 2016.
\t\tIII. The remainder of this act shall take effect 60 days after its passage.

SB 406-FN- FISCAL NOTE
AN ACT\trelative to classification of certain state employee positions and relative to the liquor commission.
FISCAL IMPACT:
The Department of Information Technology, New Hampshire Veterans Home, Department of Corrections, New Hampshire Liquor Commission, Department of Safety, and Judicial Council state this bill, as amended by the Senate (Amendment #2016-0609s), will increase state expenditures by approximately $59,000 in FY 2017, and by an indeterminable amount in FY 2018 and each year thereafter. There will be no fiscal impact to state, county, and local revenue or county and local expenditures.
METHODOLOGY:
The Office of Legislative Budget Assistant states this bill codifies in law four new unclassified positions and increases the grades and salaries for six existing unclassified positions as detailed in the tables below.

The Office of Legislative Budget Assistant states that, in the subsequent paragraphs, state agencies have identified state expenditure increases in FY 2017 and in some instances in FY 2018. However, the proposed changes will likely impact future budgets and increase state expenditures by an indeterminable amount in FY 2018 and each year thereafter.
The Department of Information Technology states this bill will increase state salary and benefits costs by approximately $24,529 in FY 2017 and $37,715 in FY 2018. The table below details the increase in state expenditures:

The New Hampshire Veterans Home states this bill will increase the salary and benefits paid to the Commandant by approximately $6,740 in FY 2017 and $10,308 in FY 2018.
The Department of Corrections states this bill will increase the salary and benefits paid to the Executive Assistant to the Parole Board by $7,294 in FY 2017.
The New Hampshire Liquor Commission states this bill will increase the salary and benefits costs of the Chairman by $7,234 in FY 2017. This bill will increase the salary and benefits costs of the Deputy Commissioner by $10,309 in FY 2017.
The Department of Safety states this bill will increase the salary and benefits of the Deputy Director of Motor Vehicles by $2,880 in FY 2017 which is the difference between FF step 6 and GG step 5. In FY 2018 and each year thereafter, this bill will increase state expenditures by $8,874, which is the difference between FF step 6 and GG step 6.
The Judicial Council states this bill upgrades the Executive Director position from CC to HH. The salary range for HH starts at $80,419 and maxes out at $106,825. The FY 2016-2017 operating budget (Chapter 275, Laws of 2015) appropriates $101,169 each year for the Executive Director position. The Department assumes the salary and benefits of the position will be less than the appropriated amounts for the biennium ending June 30, 2017. However, if the Executive Director is paid at step 5 or 6 in FY 2018 or FY 2019 then state expenditures could increase by $2,405 in FY 2018 and by $2,405 to $7,792 in FY 2019 and each year thereafter.
The Office of Professional Licensure and Certification states this bill will have no fiscal impact on its operations. The Executive Director position was funded in the FY 2016-2017 operating budget (Chapter 275, Laws of 2015) at the proposed funding level included in this bill.
The Public Utilities Commission states this bill will have no fiscal impact on its operations. The unclassified position of Administrator of the Site Evaluation Committee was established pursuant to Laws of New Hampshire 2014, Chapter 217:7 and budgeted at the GG grade in the FY 2016-2017 operating budget. This bill codifies the decision to assign a salary grade of GG made by the Joint Committee on Employee Classification at its March 9, 2015 meeting.
