STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT\testablishing a commission to study long-term peer-to-peer recovery services in New Hampshire.
Be it Enacted by the Senate and House of Representatives in General Court convened:
\t1 New Subdivision; Commission to Study Long-Term Peer-to-Peer Recovery Services in New Hampshire. Amend RSA 126-A by inserting after section 69 the following new subdivision:
Commission to Study Long-Term Peer-to-Peer
Recovery Services in New Hampshire
\t126-A:70 Commission Established; Membership.
\t\tI. There is hereby established a commission to study long-term peer to peer recovery services in New Hampshire. The membership of the commission shall be as follows:
\t\t\t(a) Two members of the senate, one of whom shall be the chairperson of the senate health and human services committee, appointed by the senate president.
\t\t\t(b) Two members of the house of representatives, one of whom shall be the chairperson of the house health, human services and elderly affairs committee, appointed by the speaker of the house of representatives.
\t\t\t(c) The commissioner of the department of health and human services, or designee.
\t\t\t(d) Two members from the governor's commission on alcohol and drug abuse prevention, treatment, and recovery established in RSA 12-J, one of whom shall be appointed by the chairperson of the governor's commission on alcohol and drug abuse prevention, treatment, and recovery established in RSA 12-J, and one of whom shall be appointed by the chairperson of the recovery task force of the governor's commission on alcohol and drug abuse prevention, treatment, and recovery.
\t\t\t(e) One member representing the community health centers, appointed by the speaker of the house of representatives.
\t\t\t(f) One superior court justice, appointed by the chief justice of the superior court.
\t\t\t(g) One member from the Veterans Administration in Manchester, appointed by the senate president.
\t\t\t(h) Two members who are in long-term opioid-recovery, one of whom shall be appointed by the governor and one of whom shall be appointed by the speaker of the house of representatives.
\t\t\t(i) Two members who are patients in clinical facilities, appointed by the president of the senate.
\t\t\t(j) Two members who are in long-term peer-to-peer recovery facilities, appointed by the senate president.
\t\t\t(k) One member representing law enforcement, appointed by the speaker of the house of representatives.
\t\t\t(l) One member representing corrections, appointed by the governor.
\t\t\t(m) One member representing behavioral health services, appointed by the governor.
\t\t\t(n) One member representing mental health services, appointed by the speaker of the house of representatives.
\t\t\t(o) One member who represents New Hampshire Hospital, appointed by the governor.
\t\t\t(p) One member from Horizons Counseling Center, appointed by the senate president.
\t\t\t(q) One member representing NH Vet to Vet, appointed by the senate president.
\t\tII. Legislative members shall receive mileage at the legislative rate while attending to the duties of the commission.
\t\tIII. The commission shall study:
\t\t\t(a) How New Hampshire could establish a comprehensive system of long-term peer-to-peer recovery facilities and assist such centers in their operation.
\t\t\t(b) How many long-term peer-to-peer facilities should be established in this state and whether the number should be per county or based on the state population.
\t\t\t(c) Whether such facilities should be established in New Hampshire prisons or jails.
\t\t\t(d) Whether such facilities should be established through a facilitating organization which would oversee licensing and data acquisition and retention.
\t\t\t(e) Whether such facilities should be licensed, accredited, or certified and if so, by what standards, and whether they should be part of a national certification process.
\t\t\t(f) Whether peer-to-peer counselors should be licensed, certified, or accredited.
\t\t\t(g) Whether there should be any other requirements for facilities and councilors.
\t\t\t(h) What accountability standards should apply to facilities and councilors.
\t\t\t(i) Whether such facilities should be state funded, and if so, to what extent should they be funded and how would such funding be distributed.
\t\t\t(j) What type of accountability requirements should apply to such facilities.\t
\t\t\t(k) How peer-to-peer facilities would interact with drug courts, law enforcement, and existing state programs.
\t\t\t(l) Whether the commissioner of the department of health and human services should request a waiver to have long-term recovery facilities included in the state plan.
\t\t\t(m) The feasibility of utilizing accountability data to establish a monthly "drug fight dash board" for distribution to the public.
\t\t\t(n) Any other issues deemed relevant by the commission.
\t\tIV. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the first-named senate member. The first meeting of the commission shall be held as soon as practicable after the effective date of this section. Twelve members of the commission shall constitute a quorum.
\t\tV. The commission shall submit an initial report of its findings and any recommendations for proposed legislation no later than October 15, 2016 to the senate president, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library. \t2 Repeal. RSA 126-A:70, relative to the commission to study long-term peer to peer recovery services in New Hampshire, is repealed.
\t\tI. Section 2 of this act shall take effect December 15, 2016.
\t\tII. The remainder of this act shall take effect upon its passage.
