STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to the aesthetic maintenance of highway intersections.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Subdivision; Aesthetic Maintenance of Highway Intersections.  Amend RSA 230 by inserting after section 83 the following new subdivision:

Aesthetic Maintenance of Highway Intersections

\t230:84  Commissioner of Transportation to Establish Program; Rulemaking. In addition to the powers and duties of the commissioner of transportation under this title, the commissioner:

\t\tI.  May establish a program for the aesthetic maintenance of limited access highway intersections by entering into agreements with private entities that are willing to maintain such intersections.  Maintenance may include, but not be limited to, grass cutting, landscaping, and litter removal.

\t\tII.  Shall permit any private entity that maintains an intersection to erect, at its own expense, a suitable advertising sign at the entrance and exit of such intersection that meets the following criteria:

\t\t\t(a)  The sign may consist of one or more panels, and shall be set in a location determined by the department to constitute no unreasonable safety risk to the public.

\t\t\t(b)  The size, materials, method of installation, text, font, and color of the sign shall meet minimum standards of the Manual on Uniform Traffic Control Devices approved by the Federal Highway Administrator as the National Standard in accordance with 23 U.S.C., sections 109(d) and 23 CFR section 655.603 as the same may be amended from time to time, provided that no sign may exceed 20 square feet in size.

\t\t\t(c)  The entity shall be identified in a single section or panel constituting no more than 1/2 of the total area of the recognition sign.

\t\tIII.  Shall adopt rules under RSA 541-A to implement the provisions of this subdivision.

\t2  Effective Date.  This act shall take effect 60 days after its passage.
