STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study the shortage of nurses for pediatric home health services.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Subdivision; Commission to Study the Shortage of Nurses for Pediatric Home Health Services.  Amend RSA 161-I by inserting after section 7 the following new subdivision:

Commission to Study the Shortage of Nurses for Pediatric Home Health Services

\t161-I:8  Commission to Study the Shortage of Nurses for Pediatric Home Health Services Established; Membership; Duties.

\t\tI.(a)  There is established a commission to study the shortage of nurses for pediatric home health services.  The members of the commission shall be as follows:

\t\t\t\t(1)  One member of the senate, appointed by the president of the senate.

\t\t\t\t(2)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t\t(3)  The commissioner of the department of health and human services, or designee.

\t\t\t\t(4)  The commissioner of the department of insurance, or designee.

\t\t\t\t(5)  The administrator of the bureau of special medical services, department of health and human services, or designee.

\t\t\t\t(6)  A representative of the New Hampshire board of nursing, appointed by the board.

\t\t\t\t(7)  A representative of the Community Support Network, Inc, appointed by that organization.

\t\t\t\t(8)   A representative of the state advisory committee on the education of students/children with disabilities, department of education, appointed by the committee.

\t\t\t\t(9)  A representative of a New Hampshire nursing agency, appointed by the governor.

\t\t\t\t(10)  Two parents of children with disabilities who utilize pediatric home health care  services, appointed by the governor.

\t\t\t(b)  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tII.(a)  The commission's study shall include, but not be limited to:

\t\t\t\t(1)  Finding a solution to the shortage of nurses for pediatric home health care services.

\t\t\t\t(2)  Training for specific intensive medical needs, palliative care, coverage in schools, and coverage by not only registered nurses and licensed practical nurses, but also licensed nursing assistants.

\t\t\t\t(3)  Financial assistance for families.

\t\t\t(b)  The commission may solicit information from any person or entity the commission deems relevant to its study.

\t\tIII.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the senate member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Seven members of the commission shall constitute a quorum.

\t\tIV.  The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2016.

\t2  Repeal.  RSA 161-I:8, relative to the commission to study the shortage of nurses for pediatric home health services, is repealed.

\t3  Effective Date.  

\t\tI.  Section  2 of this act shall take effect November 1, 2016.

\t\tII.  The remainder of this act shall take effect upon its passage.
