STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Sixteen
AN ACT\testablishing a commission to study the shortage of nurses and other skilled health care workers for home health care services and post-acute care services.
Be it Enacted by the Senate and House of Representatives in General Court convened:
\t1 New Subdivision; Commission to Study the Shortage of Nurses and Other Skilled Health Care Workers for Home Health Care Services and Post-Acute Care Services. Amend RSA 161-I by inserting after section 7 the following new subdivision:
Commission to Study the Shortage of Nurses and
Other Skilled Health Care Workers for Home Health Care Services and
Post-Acute Care Services
\t161-I:8 Commission to Study the Shortage of Nurses and Other Skilled Health Care Workers for Home Health Care Services and Post-Acute Care Services Established; Membership; Duties.
\t\tI.(a) There is established a commission to study the shortage of nurses and other skilled health care workers for home health care services and post-acute care services. The members of the commission shall be as follows:
\t\t\t\t(1) One member of the senate, appointed by the president of the senate.
\t\t\t\t(2) Three members of the house of representatives, appointed by the speaker of the house of representatives.
\t\t\t\t(3) The commissioner of the department of health and human services, or designee.
\t\t\t\t(4) The commissioner of the department of insurance, or designee.
\t\t\t\t(5) The administrator of special medical services, department of health and human services, or designee.
\t\t\t\t(6) The director of the division of higher education, department of education, or designee.
\t\t\t\t(7) A representative of the New Hampshire Nurses Association, appointed by the association.
\t\t\t\t(8) A pediatrician who provides treatment to medically fragile children, appointed by the New Hampshire Pediatric Society.
\t\t\t\t(9) An individual with experience in palliative care, appointed by the Foundation for Healthy Communities.
\t\t\t\t(10) A representative of a New Hampshire health agency, appointed by the governor.
\t\t\t\t(11) Two parents of children with disabilities who utilize pediatric home health care services, appointed by the governor.
\t\t\t\t(12) A representative of the New Hampshire workforce development entity, appointed by the commissioner of the department of health and human services.
\t\t\t\t(13) Two department deans or chairs of nursing programs from New Hampshire universities or colleges, appointed by the chancellor of the university system of New Hampshire.
\t\t\t\t(14) The department dean or chair of the nursing program from New Hampshire Technical Institute.
\t\t\t\t(15) The executive director, or designee, from the Home Care Association of New Hampshire.
\t\t\t\t(16) An adult who utilizes home health services and/or private duty nursing, appointed by the governor.
\t\t\t\t(17) A representative of the New Hampshire Health Care Association, appointed by the association.
\t\t\t\t(18) A representative of the New Hampshire Association of Counties, appointed by the association.
\t\t\t\t(19) A representative of the Granite State Home Health Association, appointed by the association.
\t\t\t\t(20) A representative of the Community Support Network, Inc., appointed by that organization.
\t\t\t\t(21) A representative of the state advisory committee on the education of children/students with disabilities, department of education, appointed by the committee.
\t\t\t(b) Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.
\t\tII.(a) The commission's study shall include, but not be limited to:
\t\t\t\t(1) Finding solutions to the shortage of nurses and other skilled health care workers for home health care services and post-acute care services, including a comprehensive examination and review of the overall delivery system for home health care services throughout the state of New Hampshire.
\t\t\t\t(2) Developing an effective strategy for workforce development, recruitment, and retention of nurses and other skilled home health care workers.
\t\t\t\t(3) Identifying workforce demands to keep pace with New Hampshire’s integrated health care delivery based on population trends and projected utilization of home health care services.
\t\t\t\t(4) Training and professional development for specific intensive medical needs, palliative care, coverage in schools, and coverage by not only registered nurses and licensed practical nurses, but also licensed nursing assistants and other skilled health care workers.
\t\t\t(b) The commission may solicit information from any person or entity the commission deems relevant to its study.
\t\tIII. The members of the commission shall elect a chairperson from among the members. The first meeting of the commission shall be called by the senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section. Thirteen members of the commission shall constitute a quorum.
\t\tIV. The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2016.
\t2 Repeal. RSA 161-I:8, relative to the commission to study the shortage of nurses and other skilled health care workers for home health care services and post-acute care services, is repealed.
\t\tI. Section 2 of this act shall take effect November 1, 2016.
\t\tII. The remainder of this act shall take effect upon its passage.
