STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trepealing the repeal of certain fees in the shoreland protection act.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Repeal.  2008, 5:27, relative to permit application fees under RSA 483-B and exemptions therefrom, is repealed.

\t2  Effective Date.  This act shall take effect upon its passage.

SB 440-FN- FISCAL NOTE

 

AN ACT\trepealing the repeal of certain fees in the shoreland protection act.

 

 

FISCAL IMPACT:

The Department of Environmental Services states this bill, as introduced, will increase state revenue and expenditures by $976,476 in FY 2017 and each year thereafter.  There will be no impact on county and local revenue or expenditures.  

 

METHODOLOGY:

The Department of Environmental Services states this bill would repeal a provision in chapter law which repeals the application fee associated with Shoreland Impact Permits under RSA 483-B, the Shoreland Water Quality Protection Act.  The Department notes, under current law, the fee will sunset July 1, 2016, but the permit requirement, and the Department’s obligations to investigate complaints and enforce compliance with the Act will remain in place.  The Department states this bill would continue the existing method of funding the program whereby application fees are deposited in a non-lapsing, fund dedicated to the implement the Act.  To date, application fees have been sufficient to administer the program without funds from other sources.  The operating budget for the program for FY 2016 and FY 2017 is $976,476.  The Department does not have information to project revenue and expenditures for future years, but for the fiscal note assumes the same level of activity as in the current budget.
