STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\tenabling municipalities to license and regulate short-term rental businesses.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; Regulation of Short-Term Rental Businesses.  Amend RSA 31 by inserting after section 95-h the following new section:

\t31:95-i  Regulation of Short-Term Rental Businesses.

\t\tI.  Any municipality may adopt an article authorizing the regulation of short-term rental businesses within the municipality.  Such regulation may include, but not be limited to:

\t\t\t(a)  Requiring a license or permit, for a fee, for the operation of a short-term rental business.

\t\t\t(b)  Requiring property inspections for building, health, fire, and life safety.

\t\tII.  "Short-term rental business" as used in this section means any person or entity which offers or advertises the rental of one or more rooms in an owner's primary residence for occupancy for less than 30 days.

\t2  Effective Date.  This act shall take effect 60 days after its passage.

SB 482-FN-LOCAL- FISCAL NOTE

 

AN ACT\tenabling municipalities to license and regulate short-term rental businesses.

 

 

FISCAL IMPACT:

The New Hampshire Municipal Association and Department of Revenue Administration state this bill, as introduced, may increase state and local revenue and local expenditures by an indeterminable amount in FY 2017 and each year thereafter.  There will be no fiscal impact to state and county expenditures or county revenue.  

 

METHODOLOGY:

The New Hampshire Municipal Association states this bill allows municipalities to regulate  short-term rental businesses.  Regulation may include requiring a license or permit for a fee, and requiring property inspections for building, health, fire, and life safety.  A municipality choosing to exercise such authority may experience increased licensing fee revenue and increased expenditures resulting from staff time needed to process licenses and conduct inspections.  

 

The Department of Revenue Administration states to the extent municipalities regulate short-term rental businesses, meals and rooms tax collections may increase.  However, the Department cannot predict how many municipalities would choose to adopt the authority provided for in this bill nor the amount of additional state revenue generated.  Any increase in state expenditures, associated with issuing more meals and rooms licenses, would be absorbed within the Department's existing budget.
