STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\trelative to the board of registration of funeral directors and embalmers.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Composition of the Board of Registration of Funeral Directors and Embalmers.  Amend RSA 325:2, I to read as follows:

\t\tI.  There shall be a board of registration of funeral directors and embalmers consisting of [5] 7 members, including 4 funeral directors or embalmers and [one] [public member] 3 public members, one of whom is an owner or manager of a business that has no pecuniary or proprietary interest in a funeral establishment or crematory or in the sale of funeral goods and services, appointed by the governor, with the approval of the council, to serve staggered terms of [5] 3 years.  The first 3 public members appointed after the effective date of this section shall serve staggered terms of 1, 2, and 3 years.  No member of the board shall be appointed to more than 2 consecutive terms.  The commissioner of the department of health and human services, or his designee, shall serve as a non-voting secretary of the board.

\t2  Public Members Shall Not Hold Funeral Licenses.  Amend RSA 325:2, III to read as follows:

\t\tIII.  The public members of the board shall be persons who are not, and never were, members of the regulated profession or the spouse of any such person, [and] who do not have, and never have had, a material financial interest in either the provision of mortuary services or an activity directly related to funeral directing or embalming, including the representation of the board or profession for a fee at any time during the 5 years preceding appointment, and who are not currently or have been licensed under this chapter in the 5 years preceding appointment.

\t3  Organization of the Board of Registration of Funeral Directors and Embalmers.  Amend RSA 325:8 to read as follows:

\t325:8  Organization; Quorum.  Within 30 days after appointment and qualification of a member, the board shall meet and elect from among its members a chairperson and such other officers as the board may provide for by rule.  This organization shall continue until the appointment of a new member or upon the resignation of an existing board officer.  The office of secretary and treasurer may be held by one member.  [Three] Four members shall constitute a quorum for the transaction of business.

\t4  Licensing of Funeral Directors Without Embalming.  Amend RSA 325:14 to read as follows:

\t325:14  Funeral Directors; Qualifications.  No person shall engage or hold himself or herself out as engaged in funeral directing, unless he or she:

\t\tI.  [Is the holder of an embalmer's license;] Is at least 18 years of age;

\t\tII.  Has obtained an associate of arts degree in mortuary science or completed a course of not less than 2 years in an accredited college;

\t\tIII.  Has completed a one-year course of training under a funeral director licensed under this chapter;

\t\tIV. [II.]  Has passed such examinations as the board may deem proper to ascertain his or her efficiency and qualifications to engage in funeral directing; and

\t\tV. [III.]  Obtains the appropriate license from the board.

\t5  Effective Date.  This act shall take effect 60 days after its passage.

AN ACT\trelative to the board of registration of funeral directors and embalmers.

 

 

FISCAL IMPACT:

The Legislative Budget Assistant has determined that this legislation, as introduced, has a total fiscal impact of less than $10,000 in each of fiscal years 2017 and 2018.
