STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\ttransferring funds from the general fund to the police standards and training council training fund, making an appropriation to the police standards and training council, making an appropriation to the department of safety for the purchase of state police cruisers, and permitting employers to pay wages to employees weekly or biweekly.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  Transfers; Police Standards and Training Council Training Fund; Appropriation; Police Standards and Training Council.

\t\tI.  The sum of $500,000 is hereby transferred from the general fund to the police standards and training council training fund in the fiscal year ending June 30, 2016.

\t\tII. For the biennium ending June 30, 2017, the sum of $900,000 is hereby appropriated to the police standards and training council for the purpose of replacing the tactical center roof and repairing the driving and parking areas.

\t\tIII.  For the purposes of funding the transfer made in paragraph I and the appropriation made in paragraph II, the governor shall identify excess appropriations from sums appropriated pursuant to 2015, 275 and 2015, 276, and shall transfer said sums to appropriate police standards and training council accounting units.  Prior to making said transfers, the governor shall certify to the fiscal committee of the general court that any excess appropriations identified pursuant to this section are in addition to the projected lapses assumed during the adoption of the state operating budget for the biennium ending June 30, 2017.  Any transfers made pursuant to this section shall not require the prior approval of the fiscal committee of the general court and the governor and council and shall not be subject to the provisions of RSA 9:16-a, 9:17-a, and RSA 9:17-c.

\t2  Police Standards and Training Council.  For the biennium ending June 30, 2017, police standards and training council accounting units 06-87-87-870510-8980, 06-87-87-871010-8999, 06-87-87-871510-8310, and 06-87-87-872010-8139 shall be exempt from budget footnote I contained in 2015, 275:1.08.

\t3  Department of Safety, Division of State Police; Appropriation.

\t\tI.  There is hereby appropriated to the department of safety, division of state police, the sum of $700,000 for the biennium ending June 30, 2017 for the purpose of the acquisition and equipping of new state police cruisers to replace those that have repairs exceeding the value of the vehicle.

\t\tII.  The source of funds for the appropriation made in paragraph I shall be $540,050 as a charge against the highway fund and $159,950 as a charge against the turnpike fund.

\t4  Payment of Wages; Weekly or Biweekly.  Amend the section heading of RSA 275:43 to read as follows:

\t275:43  Weekly or Biweekly.

\t5  Payment of Wages; Weekly or Biweekly.  Amend the introductory paragraph of RSA 275:43, I to read as follows:

\t\tI.  Every employer shall pay all wages due to employees [within 8 days including Sunday after expiration of the week in which the work is performed] at regular intervals not to exceed 14 days, except when permitted to pay wages less frequently as authorized by the commissioner pursuant to paragraph [II] IV or IV-a(a), on regular paydays designated in advance by the employer and at no cost to the employee:

\t6  Payment of Wages; Weekly or Biweekly.  Amend RSA 275:43, IV and RSA 275:43, IV-a(a) to read as follows:

\t\tIV.  The commissioner may, upon written petition showing good and sufficient reason, permit payment of wages [less frequently] other than weekly or biweekly, except that it shall be at least once each calendar month.  In all instances, payment shall be made regularly on a predesignated date.  The commissioner may prescribe the terms and conditions of such permission, and limit the duration thereof.

\t\tIV-a.(a)  The commissioner may permit payment of wages less frequently than [weekly] biweekly where a school district collective bargaining agreement for hourly employees provides an option to be paid in any number of equal installments with one additional installment.

\t7  New Paragraph; Payment of Wages; Weekly.  Amend RSA 275:43 by inserting after paragraph IV-a the following new paragraph:

\t\tIV-b.  The commissioner may, on a temporary basis and after showing good and sufficient reason, require payment of wages weekly.  The commissioner shall prescribe to the employer the terms, conditions, and duration of such temporary payments.  Such restrictions shall only be in effect until the employer rectifies any deficiencies prescribed by the commissioner.

\t8  Effective Date.

\t\tI.  Sections 4-7 of  this act shall take effect 60 days after its passage.

\t\tII.  The remainder of this act shall take effect upon its passage.

SB 527-FN-A- FISCAL NOTE

 

AN ACT\ttransferring funds from the general fund to the police standards and training council training fund, making an appropriation to the police standards and training council, making an appropriation to the department of safety for the purchase of state police cruisers, and permitting employers to pay wages to employees weekly or biweekly.

 

 

FISCAL IMPACT:

The Police Standards and Training Council and Department of Safety state this bill, as amended by the House (Amendments #2016-1804h and #2016-1936h), will increase state expenditures by an indeterminable amount in FY 2017.  There will be no impact on state revenue or county and local revenue or expenditures.

 

This bill allows for the transfer of $500,000 in general fund appropriations included in 2015, 275 and 276, in excess of projected lapses assumed during adoption of the state operating budget for the biennium ending June 30, 2017, to the Police Standards and Training Council Training Fund, effective upon certification of the Governor to the Fiscal Committee of the General Court.

 

This bill appropriates of $900,000 in general fund appropriations included in 2015, 275 and 276, in excess of projected lapses assumed during adoption of the state operating budget for the biennium ending June 30, 2017, to the Police Standards and Training Council for the purpose this act, effective upon certification of the Governor to the Fiscal Committee of the General Court.

 

This bill appropriates $540,050 from the state highway fund and $159,950 from the state turnpike fund, for the biennium ending June 30, 2017, to the Department of Safety, Division of State Police for the purpose of this act.

 

METHODOLOGY:

The Police Standards and Training Council (PSTC) states this bill allows for the transfer of $500,000 from the general fund to the PSTC Training Fund and appropriates $900,000 in general funds for the purpose of repairing the roof of the tactical center as well as the driving and parking areas.  This transfer and appropriation, however, are contingent upon the Governor certifying there are appropriations included in 2015, 275 and 275 (HB 1 and HB 2) in excess of projected lapses assumed at the adoption of the state operating budget.  Therefore, the amounts that may be transferred and/or appropriated and expended by PSTC are indeterminable.

 

The Department of Safety states this bill provides a $540,050 highway fund and $159,950 turnpike fund appropriation in the biennium ending June 30, 2017 for the purchase of State Police cruisers.  

 

The Department of Labor states this bill permits employers to pay wages to employees weekly or biweekly.  The Department states this bill have no impact on state, county, and local revenues or expenditures.
