STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study provider rates.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

 

\t1  New Subdivision; Commission to Study Provider Rates.  Amend RSA 400-A by inserting after section 67 the following new subdivision:

\t400-A:68  Commission to Study Provider Rates.

\t\tI.  There is established a commission to study provider rates.

\t\tII.  The members of the commission shall be as follows:

\t\t\t(a)  Two members of the senate, appointed by the president of the senate.

\t\t\t(b)  Three members of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t(c)  The commissioner of the department of health and human services, or designee.

\t\t\t(d)  The insurance commissioner, or designee.

\t\t\t(e)  A representative of the New Hampshire Hospital Association, appointed by the association.

\t\t\t(f)  A representative of the New Hampshire Medical Society, appointed by the society.

\t\t\t(g)  One member representing the private health insurance industry, appointed by the New Hampshire chapter of America's Health Insurance Plans.

\t\t\t(h)  A public member, appointed by the governor.

\t\tIII.  Members of the commission shall serve without compensation, except that legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

\t\tIV.  The commission shall study provider rates.  The commission's study shall include, but not be limited to, a determination of whether the public interest is violated when nonprofit hospitals offer the same services at different costs to different patients based on which insurance company is acting as third party payer.

\t\tV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the first-named senate member. The first meeting of the commission shall be held within 45 days of the effective date of this section.  Six members of the commission shall constitute a quorum.

\t\tVI.  The commission shall report its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2016.

\t2  Effective Date.  This act shall take effect upon its passage.
