STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Sixteen

 

AN ACT\testablishing a commission to study if current force protection measures provide adequate safeguards for New Hampshire national guard personnel, facilities, and equipment.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

\t1  New Section; The Militia; New Hampshire National Guard; Commission to Study Force Protection Measures.  Amend RSA 110-B by inserting after section 12 the following new section:

\t110-B:12-a  Commission to Study Force Protection Measures.  There is established a commission to study if current force protection measures provide adequate safeguards for New Hampshire national guard personnel, facilities, and equipment.

\t\tI.  The members of the commission shall be as follows:

\t\t\t(a)  One member of the senate, appointed by the president of the senate.

\t\t\t(b)  Two members of the house of representatives, appointed by the speaker of the house of representatives.

\t\t\t(c)  Two members of the New Hampshire national guard who have training in anti-terrorism and force protection, one from the New Hampshire army national guard and one from the New Hampshire air national guard, appointed by the adjutant general.

\t\t\t(d)  One civilian member of the adjutant general department who is an anti-terrorism and force protection subject matter expert.

\t\t\t(e)  Three members of the New Hampshire national guard, one from the Pease ANG base, one from the New Hampshire national guard recruiting command, and one from a standalone New Hampshire national guard readiness center, appointed by the adjutant general.

\t\tIII.  The committee shall:

\t\t\t(a)  Review all laws, regulations, and policies that affect force protection.

\t\t\t(b)  Assess force protection procedures.

\t\t\t(c)  Formulate recommendations with regard to force protection policies and procedures.

\t\t\t(d)  Seek input from the department of safety, division of homeland security and emergency management on assessments and recommendations.

\t\tIV.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the senate member and shall be held within 30 days of the effective date of this section.  Five members of the commission shall constitute a quorum.

\t\tV.  Due to the sensitive nature of the information that will be reported, the commission shall prepare a full report for limited distribution and a redacted report for a broader audience.

\t\t\t(a)  The commission shall report its full findings and any force protection recommendations, including vulnerability assessments, threat assessments, risk analysis, and risk mitigation procedures, to the speaker of the house of representatives, the president of the senate, the governor, and others with a bona fide need to know on or before November 1, 2016.

\t\t\t(b)  The commission shall report its redacted findings and any force protection recommendations, including vulnerability assessments, threat assessments, risk analysis, and risk mitigation procedures, to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2016.

\t2  Repeal.  RSA 110-B:12-a, relative to the commission to study force protection measures, is repealed.

\t3 Effective Date.

\t\tI.  Section 2 of this act shall take effect November 1, 2016.

\t\tII.  The remainder of this act shall take effect upon its passage.
