This bill provides for the continuation of 10-day, nonresident OHRV registrations.  The bill also adds a requirement for certain trail connector use on state rights of way.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to temporary OHRV registrations for nonresidents, and OHRV and snowmobile trail connectors.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Repeal; Prospective Repeals of Temporary OHRV Registrations.  2014, 286:4 through 286:6 and 286:7, I, are repealed.

2  Trail Connectors; State Rights-of-Way.  Amend RSA 236:56, II(d) to read as follows:

(d)  Trail Connectors.  

(1) All OHRVs and snowmobiles may be operated within specified trail connectors and pursuant to the provisions of RSA 215-A:9 or RSA 215-C:9. The commissioner of the department of transportation may limit the operation of specified types of OHRVs and snowmobiles when the commissioner feels this is necessary in matters of safety and maintenance of trail corridors or at the suggestion of the chief supervisor of the bureau of trails. Trail connectors, as defined in RSA 215-A:1, in Coos county and in Grafton county shall be exempt from the provisions of RSA 215-A:42 and RSA 215-A:43.

(2)  Notwithstanding the provisions of subparagraph (1), the requirement in RSA 215-A:43, I(a) shall apply to trail connectors for the use of state highway rights-of-way, outside of the travel lane.

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill repeals the repeal in Chapter 286, Laws of 2014, of the 10-day temporary nonresident OHRV registrations.  During FY 2017 1,742 10-day nonresident OHRV registrations were sold by the Fish and Game Department (F&G).  Individuals seeking to purchase the aforementioned registration will pay a fee of $40; $24 of which is transferred to the Department of Resources and Economic Development (DRED) and $16 is provided to F&G.  F&G incurs a cost of approximately $3 in materials (i.e., decals and forms) for each registration sold.  The following table includes the Departments' revenue and expenditure estimates:

Revenue and expenditures are lower in FY 2018 because this bill only impacts revenue after January 1, 2018, due to the existing repeal date of Chapter 286, Laws of 2014.  A majority of registrations are sold annually between July and October.
** This analysis assumes the total number of OHRV registrations sold in the future will be the same as the number sold in FY 2017.   F&G anticipates the number of 10-day nonresident OHRV registrations issued may increase in the future because the nonmember nonresident annual and 14 month ATV and trail bike registration fees will be increasing effective May 2018.    

*** Revenue transferred to DRED is restricted revenue.  Of the total amount transferred from each registration, $10 is appropriated to the Bureau of Trails for purposes that include publications, trail maintenance and acquisition, land purchases, and OHRV facilities; and $14 is appropriated for the grant-in-aid program.

****Revenue transferred to F&G is restricted revenue.  Of the total amount transferred from each registration, $10 is for purposes that include enforcement of RSA 215-A & C, establishing snowmobile and OHRV training programs, and law enforcement; $1 is deposited into the Search and Rescue fund; and $5 is deposited into the Fish and Game fund.
