STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT relative to number plate scanning devices.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Number Plate Scanning Devices; Audits.  Amend RSA 261:75-b, X to read as follows:

X.  To ensure compliance with the provisions of this section or to investigate complaints of misuse of LPR devices, the attorney general or a designee of the department of justice including county attorneys and law enforcement officers acting at the request of the attorney general may examine and audit any LPR device, a server used to store LPR data, and records pertaining to the use of LPR devices maintained by any state, county, or local law enforcement agency and the department of justice may seek an injunction banning the use of LPR devices by an agency found to have used an LPR device or devices in repeated violation of this section and requiring the confiscation of LPR devices if the attorney general deems it necessary to prevent ongoing violations or deter future violations of this subdivision.  To facilitate the examination and auditing of LPR devices, any state, county, or local law enforcement agency using an LPR device shall maintain records identifying, for each use of the device, the officer involved and the purpose authorized by paragraph V.

2  New Paragraphs; Number Plate Scanning Devices.  Amend RSA 261:75-b by inserting after paragraph XI the following new paragraphs:

XII.  The hardware and software of each LPR device shall be open sourced and available for public inspection.  Each state, county, or local law enforcement agency using an LPR device shall establish procedures allowing public inspection of the device to verify the hardware and software on the device.

XIII.  All number plate data stored on an LPR device or a server used to store LPR data shall be encrypted.

XIV.  Each state, county, or local law enforcement agency using an LPR device shall require periodic training on information security for all device operators.

3  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill provides additional requirements for license plate readers under RSA 261:75-b for State, county, and municipal law enforcement, such as utilizing open sourced hardware and software with encrypted data storage.  Based on the information provided, there would be an indeterminable increase to State, county, and local entities.  Additionally, the Department of Safety notes it is unknown whether current technology is capable of the proposed legislative requirements or which other State funds would be impacted.
