AN ACT clarifying the application of the road toll.

AMENDED ANALYSIS

 

This bill:

 

I.  Modifies the description of vehicles using special fuel on which the supplier has prepaid the road toll fees.

 

II.  Repeals the provision entitling diplomats to a refund of the road toll.

 

III.  Repeals the exemption from the road toll for diplomatic and consular personnel.

 

This bill is a request of the department of transportation.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Seventeen

 

AN ACT clarifying the application of the road toll.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

177:1  Adminisration of Motor Vehicle Laws; Road Toll on Users of Special Fuel.  Amend RSA 260:52, I to read as follows:

I.  All users of special fuel who travel exclusively (intrastate) on the ways of the state of New Hampshire shall use only special fuel on which the supplier has prepaid the New Hampshire road toll fees.  Vehicles powered by special fuels having a gross registered weight in excess of 26,000 pounds or having 3 or more axles regardless of weight, or when the weight of such vehicle or combination of vehicles exceeds 26,000 pounds, that travel on the ways of New Hampshire that also travel in any other state, province, or other IFTA jurisdiction shall meet the licensing and reporting requirements of the International Fuel Tax Agreement (IFTA).

177:2  Administration of Motor Vehicle Laws; Road Toll on Users of Special Fuel.  Amend RSA 260:52, III(a) to read as follows:

(a)  Vehicles owned by the [federal] United States government for the use of the armed forces only, the state, a city, town, county, village, or school district.

177:3  Repeal.  The following are repealed:

I.  RSA 260:47, V, relative to refunds to diplomatic personnel eligible for an exemption from motor fuel tax.

II.  RSA 260:52, III(b), relative to exemption from the road toll for diplomatic or consular personnel.

177:4  Effective Date.  This act shall take effect 60 days after its passage.
