STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT requiring a portion of rental fees for canoes, kayaks, and personal watercraft to be deposited in the fish and game search and rescue fund.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; Rental of Canoes, Kayaks, and Personal Watercraft.  Amend RSA 270-E by inserting after section 25 the following new subdivision:

Rental of Canoes, Kayaks, and Personal Watercraft

270-E:26  Rental of Canoes, Kayaks, and Personal Watercraft.  A rental agent shall quarterly remit one dollar from the rental of each canoe, kayak, ski craft as defined in RSA 270:73, V, or watercraft as defined in RSA 270:73, VI, to the state treasurer who shall credit such funds to the fish and game search and rescue fund established in RSA 206:42.

2  Fish and Game Search and Rescue Fund.  Amend RSA 206:42 to read as follows:

206:42  Fish and Game Search and Rescue Fund.  The additional fee of $1 collected under the provisions of RSA 270-E:5, II(b) for each private boat registered, under RSA 270-E:26 for each rental of a canoe, kayak, ski craft, or watercraft, under RSA 215-A:23, X for each OHRV registered, and under RSA 215-C:39, XI for each snowmobile registered, shall be paid over to the state treasurer who shall keep such fees in a special fund to be expended by the fish and game department for use in search and rescue operations.  The special fund shall be nonlapsing.  All funds received under this subdivision are continually appropriated to the fish and game department for the purposes of this subdivision.  The fish and game department shall report to the fiscal committee on a quarterly basis beginning on October 1, 1989, on the expenditures made from the fund.

3  Effective Date.  This act shall take effect 60 days after its passage.

FISCAL IMPACT AND METHODOLOGY:

This bill requires $1 from the rental of each canoe, kayak, ski craft, or watercraft, as defined in RSA 271:73, be remitted to the state from rental agents on a quarterly basis.  All revenue would be credited to the fish and game search and rescue fund.  Currently, there are 28 permitted rental agents, however it is unknown how many individual rentals are made and therefore the revenue increase as a result of this bill is indeterminable.  It is assumed collection and administration will be performed by the Department of Safety.  Any expenses relative to collecting and auditing of revenue is estimated to be less than $10,000 per year.
