STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Eighteen
AN ACT naming a certain bridge connecting Dover and Newington the Ruth L. Griffin bridge and establishing the fallen state troopers' memorial committee.
Be it Enacted by the Senate and House of Representatives in General Court convened:
339:1 Naming a Bridge Connecting Dover and Newington the Ruth L. Griffin Bridge. Pursuant to RSA 4:43, the southbound bridge on Route 16 (Spaulding turnpike) connecting the town of Dover with the town of Newington is hereby named the Ruth L. Griffin bridge. A suitable marker may be placed at the site of the bridge.
339:2 Signage. The cost of design, construction, maintenance, and installation of any signage, replacement signage, or other markers required under section 1 of this act shall not be a charge to the state. The design, construction, and installation of any signage or other markers required under section 1 of this act shall be approved by the department of transportation.
339:3 New Subdivision; New Hampshire Fallen State Troopers' Memorial. Amend RSA 4 by inserting after section 9-m the following new subdivision:
Fallen State Troopers' Memorial
4:9-n Fallen State Troopers’ Memorial.
I. There shall be a memorial to commemorate law enforcement members of the division of state police who gave their lives in the performance of duty. Notwithstanding other provisions of law to the contrary, the memorial shall be situated on the grounds of or on state owned land adjacent to the state police headquarters at the James H. Hayes Safety Building on Hazen Drive in the city of Concord. The governor is authorized to accept in the name of the state the fallen state troopers’ memorial as a private gift to the state upon its completion.
II. The commissioner of the department of administrative services, or designee, shall act as the custodian for the memorial, and shall have charge of all matters relating to the care, maintenance, and repair of, and additions to, the memorial. For the purpose of this section the provisions of RSA 21-I shall not apply.
III. The commissioner of the department of administrative services, or designee, shall administer and disburse to the committee established in RSA 4:9-o, the moneys in the special nonlapsing account established in RSA 4:9-o. No money other than necessary expenses prior to construction shall be disbursed until the governor and council approve and award the contract for the construction of the memorial.
IV. No person shall use the fallen state troopers’ memorial for any commercial purpose. This prohibition shall not apply to use by the New Hampshire Troopers Association or any other nonprofit law enforcement organization registered with the director of charitable trusts to fund the upkeep and maintenance of the memorial provided that the use of the memorial is approved by the department of administrative services and by the committee established in RSA 4:9-o. Any person or organization that violates the provisions of this paragraph shall be guilty of a violation and subject to a fine of $500 plus penalty assessment.
4:9-o Committee and Special Account Established.
I. A committee is established to select the design for a fallen state troopers’ memorial, to oversee the construction of the memorial, to privately raise all of the funds necessary for its construction and maintenance, and to expend for those purposes the funds which are raised. The governor is authorized to accept for the committee, in the name of the state, the gifts of money which are donated for purposes of the memorial.
II. The gifts of money donated to construct and maintain the memorial shall be placed in a special, nonlapsing account in the state treasury, to be expended for the purposes of the fallen state troopers' memorial. Any money remaining after construction of the memorial is completed shall be used for the care, maintenance, and repair of, and additions to, the memorial, or for any other relevant purpose deemed appropriate by the committee.
III. The committee shall remain in existence upon completion of the memorial for the purposes of funding any future changes, repairs, or improvements to the memorial including addition of additional names and regular ongoing maintenance of the memorial and site.
IV. The members of the fallen state troopers’ memorial committee shall be as follows:
(a) One member appointed by the New Hampshire Troopers Association of the rank of sergeant or below, from the ranks of the New Hampshire state troopers, appointed by that association.
(b) One member appointed by the New Hampshire Troopers Association from the ranks of the New Hampshire Troopers Association command staff, appointed by that association.
(c) One member of the New Hampshire State Police Benevolent Association, appointed by that association.
(d) One sworn law enforcement member of the division of state police other than a trooper, appointed by the director of the division of state police.
(e) The commissioner of the department of safety, or designee.
(f) The commissioner of the department of administrative services, or designee.
(g) One member who is a family member of a state trooper, appointed by the director of the division of state police.
V. The members of the committee shall serve at the pleasure of the appointing authority and shall elect a chairperson from among the members. The first meeting shall be called by the commissioner of safety. Four members of the committee shall constitute a quorum.
VI. The committee shall:
(a) Select the design and siting for the fallen state troopers’ memorial.
(b) Oversee the construction of the memorial. The award of the contract for the construction of the memorial shall be subject to the approval of the governor and council.
(c) Advise and inform the city manager of the city of Concord or designee relative to the design and construction plans for the memorial.
(d) Inform the long range capital planning and utilization committee established in RSA 17-M regarding the plans for the memorial.
(e) Privately raise, through and in collaboration with the New Hampshire Troopers Association, the money necessary for the planning, design, construction, and maintenance of the fallen state troopers’ memorial, and shall have the authority without the approval of the governor and council, to expend the money which is raised.
339:4 New Subparagraph; New Hampshire Fallen State Troopers' Memorial Fund. Amend RSA 6:12, I(b) by inserting after subparagraph (339) the following new subparagraph:
(340) Moneys deposited into the New Hampshire fallen state troopers' memorial account established in RSA 4:9-o.
339:5 Effective Date. This act shall take effect 60 days after its passage.
