STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Eighteen

 

AN ACT allowing the waiver of fees for reinstatement of a driver's license and registration in cases of demonstrated financial hardship.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Registration Fees.  Amend RSA 261:141, X to read as follows:

X.  Whenever a registration has been suspended, a fee of $25 shall be paid for the restoration of such registration.  Such fee shall be in addition to the fee required under RSA 263:42, V.  This $25 shall be placed in the highway fund.  The commissioner may waive this fee for demonstrated financial hardship.  All moneys remaining in the supplementary motor vehicle fund shall lapse to the highway fund on July 1, 1991.

2  Driver's License Fees.  Amend RSA 263:42, V(a) to read as follows:

V.(a)  Whenever a driver's license has been suspended or revoked, or notwithstanding RSA 263:56-a, III, whenever the holder of a commercial driver license has been disqualified for a period of greater than 15 days, a fee of $100 shall be paid by the licensee for the restoration of such license or commercial driver license; provided, however, that in the event of a license suspension under RSA 263:14, a fee of $50 shall be paid by the licensee for the restoration of the original or youth operators' license.  Under certain conditions the commissioner may waive the restoration fee for a default or suspension, including demonstrated financial hardship.  The commissioner shall adopt rules, under RSA 541-A, relative to such waiver procedures.

3  Suspension or Revocation for Default.  Amend RSA 263:56-a, III(a) to read as follows:

(a)  Payment to the director of a fee of $100, which shall be in lieu of any other reinstatement fee and shall be deposited into the highway fund pursuant to RSA 260:23 and RSA 6:12, I(b)(5), provided, however, that in the event of a license suspension under RSA 263:14, a fee of $50 shall be paid to the director in lieu of the reinstatement fee under RSA 263:42, V and shall be deposited into the highway fund pursuant to RSA 260:23 and RSA 6:12, I(b)(5); and provided further that the commissioner may waive any fee under this subparagraph for demonstrated financial hardship and

4  License Restored Upon Expiration of Revocation Period.  Amend RSA 263:71, I to read as follows:

I.  Any required application and fee have been submitted or waived by the commissioner for demonstrated financial hardship; and

5  Effective Date.  This act shall take effect 60 days after its passage.

*Pursuant to Part II, article 6-a of the New Hampshire constitution, any costs associated with the collection and administration of Highway Funds by the Department of Safety shall be deducted by the Department before such funds are credited to the Highway Fund as unrestricted revenue.

 

METHODOLOGY:

This bill authorizes the commissioner of safety to waive fees for the reinstatement of a driver’s license and registration in cases of demonstrated financial hardship.  While it cannot be predicted how much in fees will be waived, but for informational purposes, in FY 2017 there was a total of $2,015,520 in restoration revenue collected.
