STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relating to youth operator's licenses.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Conditions and Requirements for a License; Original and Youth Operators' Licenses.  Amend RSA 263:14, II(b) to read as follows:

(b)  The holder of a youth operator's license shall not operate a motor vehicle between the hours of 1:00 a.m. and 4:00 a.m. without approval from the director pursuant to paragraph VI, nor shall such holder operate a motor vehicle when the number of occupants exceeds the number of safety restraints in the vehicle.

2  New Paragraph; Conditions and Requirements for a License; Original and Youth Operators' Licenses.  Amend RSA 263:14 by inserting after paragraph V the following new paragraph:

VI.  Upon application, the director may approve a holder of a youth operator's license to operate a motor vehicle between the hours of 1:00 a.m. to 4:00 a.m. for the purpose of traveling between the youth operator's home residence and a place of employment or between the youth operator's home residence and his or her school.  Such application shall be made on a form prescribed by the director, and shall include a signed statement of need from either the youth operator's employer or school.

3  Effective Date.  This act shall take effect 60 days after its passage.

*Pursuant to Part II, article 6-a of the New Hampshire constitution, any costs associated with the collection and administration of Highway Funds by the Department of Safety shall be deducted by the Department before such funds are credited to the Highway Fund as unrestricted revenue.

 

METHODOLOGY:

This bill allows certain youth operators of motor vehicles to drive between the hours of 1:00 a.m. and 4:00 a.m. upon submission of an application to the Director of the Division of Motor Vehicles and subsequent approval.  The Department of Safety is unable to estimate how many of the approximately 15,000 youth operators a year would apply for the permission to operate a vehicle during these hours for school or employment purposes.  Therefore, Department expenditures will be impacted by an indeterminable amount.  However, the Department estimates this bill will impact expenditures by requiring the creation of an electronically available form and a high volume of applications may require additional processing resources.
