ANALYSIS

 

This bill prohibits the director's consideration of convictions occurring prior to a driver's most recent license revocation for purposes of certifying an individual as a habitual offender.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to certifying as a habitual offender.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Habitual Offenders; Procedure.  Amend RSA 262:19 by inserting after paragraph I the following new paragraph:

I-a.  In determining whether a person qualifies as a habitual offender within the meaning of RSA 259:39, the director shall only consider those convictions occurring after the most recent license restoration granted pursuant to RSA 262:24.

2  Effective Date.  This act shall take effect 60 days after its passage.
