STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to the definition of emergency vehicles.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  Motor Vehicles; Words and Phrases Defined; Emergency Vehicle.  Amend RSA 259:28 to read as follows:

259:28  Emergency Vehicles.  "Emergency vehicles" shall mean all vehicles of fire departments and police departments, [and] such ambulances and emergency vehicles of municipal departments or public service corporations as authorized by the director, and transportation and field services vehicles of the New Hampshire department of corrections.

2  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill adds certain vehicles of the Department of Corrections to the definition of emergency vehicle.  The Department of Corrections indicates the vehicles used for security are currently outfitted with lights and sirens.  This bill would add these vehicles to the definition of emergency vehicle to allow for lawful use of the sirens and lights when stopping suspicious vehicles on the prison facility perimeter, accompanying  other emergency vehicles, such as ambulances transporting individuals under Department control, or if the need ever arises, to pursue individuals under Department control attempting to escape.  For the Department's field services vehicles, 23 vehicles would be fitted with blue lights in the front grill and back window.  The cost per vehicle would be $675 for a total cost of $15,575 in FY 2020.  Future costs would  be less since vehicles would not be replaced all at once and lights that could be reused would be installed on the replacement vehicles.

 

The Department of Safety indicates the bill would have no fiscal impact on the Department.
