STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT establishing a commission to study highway fund revenue for hybrid and electric vehicles.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Section; Highway Fund Revenue for Hybrid and Electric Vehicles; Commission Established.  Amend RSA 260 by inserting after section 34-a the following new section:

260:34-b  Commission Established.

I.  Commission Established.  There is established a commission to study revenue alternatives to the road toll for electric-powered and hybrid vehicles for funding improvements to the state's highways and bridges.

II.  The members of the commission shall be as follows:

(a)  One member of the senate, appointed by the president of the senate.

(b)  Two members of the house of representatives, appointed by the speaker of the house of representatives, one of whom shall be a member of the public works and highways committee and one of whom shall be a member of the ways and means committee.

(c)  The commissioner of the department of revenue administration, or designee.

(d)  The commissioner of the department of safety, or designee.

(e)  The commissioner of the department of transportation, or designee.

(f)  The commissioner of the department of environmental services, or designee.

(g)  One representative of the Business and Industry Association of New Hampshire, appointed by the association.

(h)  One representative of the New Hampshire Automobile Dealers Association, appointed by the association.

(i)  One member representing the environmental community, appointed by governor.

(j)  One member of the New Hampshire City and Town Clerks Association, appointed by the association.

(k)  One representative of the New Hampshire Municipal Association, appointed by the association.

(l)  One representative of AAA Northern New England, appointed by the association.

(m)  One representative of the road building industry, appointed by the Associated General Contractors of America, New Hampshire chapter.

(n)  One representative of the trucking industry, appointed by the New Hampshire Motor Transport Association.

(o)  One representative of Drive Electric NH, appointed by the coalition.

(p)  One representative of the American Council of Engineering Companies of New Hampshire, appointed by the council.

III.  Legislative members of the commission shall receive mileage at the legislative rate when attending to the duties of the commission.

IV.  The commission shall study alternatives to the road toll for electric powered, hybrid, and fuel-efficient vehicles, and may study other emerging vehicle fuels and technologies, for funding improvements to the state's highways and bridges, ensuring that all motor vehicles contribute proportionally to their impact on New Hampshire's highway infrastructure.  The commission shall also track current road toll revenues and, as it deems appropriate, analyze related programs developed in other states and recommend legislation.

V.  The members of the commission shall elect a chairperson from among the members.  The first meeting of the commission shall be called by the senate member.  The first meeting of the commission shall be held within 45 days of the effective date of this section.  Seven members of the commission shall constitute a quorum.  The commission shall submit a report of its findings and any recommendations for proposed legislation to the president of the senate, the speaker of the house of representatives, the senate clerk, the house clerk, the governor, and the state library on or before November 1, 2020.

2  Repeal.  RSA 260:34-b, relative to commission to study revenue alternatives to the road toll for electric-powered and hybrid vehicles for funding improvements to the state's highways and bridges, is repealed.

3  Effective Date.  

I.  Section 2 of this act shall take effect November 1, 2020.

II.  The remainder of this act shall take effect upon its passage.
