This bill establishes the position of independent human resources professional in the general court administrative office.  The bill also requires members of the general court to receive training on sexual harassment and authorizes the human resources professional to handle sexual harassment complaints.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Nineteen

 

AN ACT relative to sexual harassment complaints in the general court and authorizing an independent human resources professional.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Subdivision; General Court Administrative Office.  Amend RSA 14 by inserting after section 51 the following new subdivision:

General Court Administrative Office

14:52  Administrative Office.  

I.  There shall be a general court administrative office in the state house under a director of the administrative office.  The director may employ such additional professional, technical, clerical or other employees necessary to perform the functions and duties of the office.

II.  The director shall employ an independent human resources professional.  The human resources professional, in addition to the procedure in RSA 14-B:3, I(d), shall have responsibility for the receipt, investigation, and processing of complaints involving sexual harassment.  Neither the office of the senate president nor the office of the speaker of the house of representatives shall have any oversight or responsibility for any complaints involving sexual harassment.

2  New Paragraph; Joint Committee on Legislative Facilities; Duty Added.  Amend RSA 17-E:5-a by inserting after paragraph X the following new paragraph:

XI.  To review sexual harassment policies of other jurisdictions and adopt a sexual harassment policy consistent with best practices; and to determine the procedures for the independent human resources professional in the general court administrative office to address sexual harassment complaints.

3  New Section; Members of the General Court; Required Training on Sexual Harassment.  Amend RSA 14-A by inserting after section 6 the following new section:

14-A:7  Required Training on Sexual Harassment.  Members of each body of the general court shall undertake at least one 3-hour training on sexual harassment to be offered at least 2 different times.  One such training shall be offered in December after organization day and one on or around convening day.  The training shall be administered by the independent human resources professional in the general court administrative office, along with any other persons the human resources professional deems appropriate.  The failure to attend a training shall be grounds for sanctions of, at a minimum, not being seated on a standing committee.

4  Effective Date.  This act shall take effect 60 days after its passage.

METHODOLOGY:

This bill establishes the position of independent human resources professional in the general court administrative office who shall have the responsibility for the receipt, investigation, and processing of complaints involving sexual harassment.  This bill also requires members of the general court to receive training on sexual harassment.  This bill will increase state expenditures by an indeterminable amount, depending on the compensation of the independent human resources professional.
