AN ACT prohibiting motorcycle profiling.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT prohibiting motorcycle profiling.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

51:1  New Section; Motor Vehicles; Obedience to and Effect of Traffic Laws; Motorcycle Profiling Prohibited.  Amend RSA 265 by inserting after section 1-b the following new section:

265:1-c  Motorcycle Profiling Prohibited.  No state, county, or municipal law enforcement agency shall engage in motorcycle profiling.  In this section, "motorcycle profiling" shall mean use of the fact that a person rides a motorcycle or wears motorcycle-related paraphernalia as a basis for deciding to stop and question, take enforcement action, arrest, or search a person or vehicle under the United States Constitution or the New Hampshire constitution.

51:2  Effective Date.  This act shall take effect 60 days after its passage.
