STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Committee Established. There is established a committee to study the New Hampshire law relative to soil conditioners.
2 Membership and Compensation.
I. The members of the committee shall be as follows:
(a) Three members of the house of representatives, appointed by the speaker of the house of representatives.
(b) One member of the senate, appointed by the president of the senate.
II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.
3 Duties. The committee shall review RSA 431 and assess the following:
I. Are statutes consistent with current agricultural practices?
II. Are all terms appropriately defined, including the term “soil conditioner"?
III. Are all fees directed to appropriate, specific purposes supporting agriculture?
4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 90 days of the effective date of this section. Three members of the committee shall constitute a quorum.
5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2022.
6 Oil Discharge and Disposal Cleanup Fund; Eligible Expenses and Availability of Funds. Amend RSA 146-D:6, III to read as follows:
III. Owners of on-premises-use facilities who have demonstrated financial need may apply for reimbursement of costs to meet local and department operating standards in amounts not to exceed a total of [$2,250] $3,300, and may apply for reimbursement of underground storage tank abandonment or removal costs in amounts not to exceed a total of $2,500.
I. Section 6 of this act shall take effect January 1, 2023.
II. The remainder of this act shall take effect upon its passage.

METHODOLOGY:
This bill would increase the amount of reimbursement allowable for low-income home heating oil tank owners to upgrade or replace their oil tanks to meet local and state requirements. The bill would increase the allowable reimbursement from $2,250 to $3,300 per tank. This reimbursement program, known as the SAFETANK program, is funded by the Oil Discharge and Disposal Cleanup Fund (“Fund”) established in RSA 146-D. Based on the average number of tank upgrade/replacements this program funds per year (180), the Department estimates that the amendment would result in additional expenditures of $189,000 per year from the Fund. Since this bill goes into effect January 1, 2023, the amount estimated for FY 2023 would be half of a full year amount ($94,500). There is no anticipated impact to state revenue, or county and local revenue or expenditures.
