STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
Be it Enacted by the Senate and House of Representatives in General Court convened:
198:1 Committee Established. There is established a committee to study the feasibility of centralized criminal history records checks in education.
198:2 Membership and Compensation.
I. The members of the committee shall be as follows:
(a) Four members of the house of representatives, one of whom shall be from the education committee, one from the executive departments and administration committee, and one from the criminal justice and public safety committee, appointed by the speaker of the house of representatives.
(b) One member of the senate, appointed by the president of the senate.
II. Members of the committee shall receive mileage at the legislative rate when attending to the duties of the committee.
198:3 Duties. Because current law allows the department of education to conduct criminal history records checks for school bus drivers and transportation monitors so that they can work for multiple school districts with only one check, and other professions also work with multiple schools or school districts but need to apply for a separate, independent records check for each since the results cannot be shared nor sent to other than a government entity, the study committee shall investigate:
I. Which professions often serve multiple schools;
II. The degree of mobility within the education-related professions subject to a criminal history records check;
III. The availability of other background clearance procedures, such as from a professional regulatory board;
IV. Any restrictions on sharing the results of criminal history records checks; and
V. Any other questions which would encourage or mitigate against having the department of education maintain such a registry of pre-cleared professionals.
198:4 Chairperson; Quorum. The members of the study committee shall elect a chairperson from among the members. The first meeting of the committee shall be called by the first-named house member. The first meeting of the committee shall be held within 45 days of the effective date of this section. A majority of members of the committee shall constitute a quorum.
198:5 Report. The committee shall report its findings and any recommendations for proposed legislation to the speaker of the house of representatives, the president of the senate, the house clerk, the senate clerk, the governor, and the state library on or before November 1, 2023.
198:6 Effective Date. This act shall take effect upon its passage.
