Floor Amendment to HB 1400

 

Amend RSA 595-A:11 as inserted by section 1 of the bill by replacing it with the following:

 

595-A:11  Probable Cause; Scent of Marijuana Prohibited.  The scent of marijuana shall not, by itself, be sufficient to establish probable cause to conduct a search or to request a search warrant.

This bill prohibits using the scent of marijuana alone to establish probable cause for a search.
