Amendment to HB 1409

 

Amend the bill by replacing all after the enacting clause with the following:

 

1  New Subdivision; Mental Health Practice; Services Provided to Minors.  Amend RSA 135-C by inserting after section 67 the following new subdivision:

Mental Health Services for Minors

135-C:68  Mental Health Services; Consent of Minor.  A minor 16 years of age or older may voluntarily consent to mental health services, and a licensed mental health care provider may provide such services without the consent of the minor's parent or legal guardian, provided, however, that the provider shall not prescribe medication without the consent of a parent or guardian.

2  Effective Date.  This act shall take effect 60 days after its passage.

This bill allows a minor 16 years of age or older to consent to mental health treatment without parental consent.
