AN ACT relative to consent for mental health treatment in parenting cases with shared decision-making responsibility.

ANALYSIS

 

This bill provides that in parenting cases with shared decision-making responsibility, either parent may consent to mental health treatment for the child provided that the parent notifies the other parent of the decision.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT relative to consent for mental health treatment in parenting cases with shared decision-making responsibility.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Parenting Plans; Consent to Mental Health Treatment.  Amend RSA 461-A:4 by inserting after paragraph IV the following new paragraph:

IV-a.  If the parents have joint decision-making responsibility, either parent may consent to counseling services or other mental health treatment for the child, provided that the parent who obtains such services for the child notifies the other parent before treatment begins.

2  Effective Date.  This act shall take effect January 1, 2023.
