STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
AN ACT relative to eligibility of individuals for developmental disability services.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Services for the Developmentally Disabled; Definition of Developmental Disability; Familial Dysautonomia Added. Amend RSA 171-A:2, V to read as follows:
V. "Developmental disability" means a disability:
(a) Which is attributable to an intellectual disability, cerebral palsy, epilepsy, autism, familial dysautonomia, or a specific learning disability, or any other condition of an individual found to be closely related to an intellectual disability as it refers to general intellectual functioning or impairment in adaptive behavior or requires treatment similar to that required for persons with an intellectual disability; and
(b) Which originates before such individual attains age 22, has continued or can be expected to continue indefinitely, and constitutes a severe disability to such individual's ability to function normally in society.
2 Effective Date. This act shall take effect 60 days after its passage.

METHODOLOGY:
This bill adds familial dysautonomia (FD) to the definition of a developmental disability in RSA 171-A:2, V. The Department of Health and Human Services states that as a result of this change, individuals with FD will be categorically eligible to receive developmental services regardless of functional impairments. The Department estimates that, because the condition is extremely rare, SA affects approximately two people in the state, out of approximately 150 nationwide. Consistent with the cost of other developmental services in the state, the Department estimates an average cost of $65,000 per individual per year, for a total cost of $130,000 per year. Of this, half would be paid for with state general funds and half with matching federal funds.
It is assumed that the fiscal impact will begin in FY 2023.
