STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Twenty Two
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 New Paragraph; Air Toxic Control Act; Definitions; PFAS. Amend RSA 125-I:2 by inserting after paragraph X the following new paragraph:
X-a. "PFAS" means per and polyfluoroalkyl substances.
2 New Paragraph; Regulated Toxic Air Pollutants. Amend RSA 125-I:4 by inserting after paragraph V the following new paragraph:
VI. By January 1, 2023 and annually thereafter, the commissioner shall conduct a review to determine whether there exists at least one study that has been conducted in accordance with generally accepted scientific principles that demonstrates that any individual PFAS is known to cause or may reasonably be anticipated to cause acute, chronic, mutagenic, reproductive, or developmental health effects in humans as a result of inhalation exposure to such PFAS analyte. If a study exists, the commissioner may modify the list of regulated toxic air pollutants by adding such PFAS analyte to the list, or by establishing or modifying any classification or ambient air limit for such PFAS analyte by adopting rules in accordance with the provisions of RSA 541-A.
3 Effective Date. This act shall take effect January 1, 2023.

AS AMENDED BY THE HOUSE (AMENDMENT #2022-0899h)
AN ACT defining PFAS and enabling the commissioner of the department of environmental services to adopt rules relative to airborne PFAS in certain circumstances.
FISCAL IMPACT:
The Legislative Budget Assistant has determined that this legislation, as amended, has a total fiscal impact of less than $10,000 in each of the fiscal years 2022 through 2025.
