This bill permits gifts, grants, donations, and development fees to be credited to the harbor dredging and pier maintenance fund.  The bill also makes appropriations for the dredging of the Rye harbor and the Seabrook/Hampton harbor.

STATE OF NEW HAMPSHIRE

 

In the Year of Our Lord Two Thousand Twenty Two

 

AN ACT relative to funds credited to the harbor dredging and pier maintenance fund and making appropriations for the dredging of Rye harbor and Seabrook/Hampton harbor.

 

Be it Enacted by the Senate and House of Representatives in General Court convened:

 

1  New Paragraph; Division of Ports and Harbors; Harbor Dredging and Pier Maintenance Fund.  Amend RSA 12-G:46 by inserting after paragraph III the following new paragraph:

IV.  Gifts, grants, development fees, and donations from federal, private, and other sources may be credited to the fund.

2  Appropriations; Dredging of Rye Harbor and Seabrook/Hampton Harbor.  

I.  The sum of $243,750 for the fiscal year ending June 30, 2023 is hereby appropriated to the state treasurer to be distributed equally to the municipalities adjacent to the Seabrook/Hampton harbor for the dredging of the Seabrook/Hampton harbor.  The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

II.  The sum of $637,500 for the fiscal year ending June 30, 2024 is hereby appropriated to the state treasurer to be distributed equally to the municipalities adjacent to Rye harbor for the dredging of the Rye harbor.  The governor is authorized to draw a warrant for said sum out of any money in the treasury not otherwise appropriated.

3  Effective Date.

I.  Section 2 of this act shall take effect July 1, 2022.

II.  The remainder of this act shall take effect upon its passage.

METHODOLOGY:

This bill makes two general fund appropriations:

  • In FY 2023, $243,750 is appropriated to the State Treasurer to be distributed equally to the municipalities adjacent to the Seabrook/Hampton Harbor, for the purpose of dredging said harbor. This is assumed to be $121,875 for each the towns of Seabrook and Hampton.

 

  • In FY 2024, $637,500 is appropriated to the State Treasurer to be distributed equally to the municipalities adjacent to the Rye Harbor, for the purpose of dredging said harbor. This is assumed to be entirely for the town of Rye.

 

According to the Pease Development Authority, Division of Ports and Harbors, it should be noted the municipalities do not have a roll in the dredging of the harbors, anchorages, or channels. There are no municipal dredge areas, it is primarily federal with a small state anchorage in the towns of Hampton and Rye. By statue, and agreement with the US Army Corps of Engineers, the Division of Ports and Harbors is the local (state) sponsor. Therefore, it is unclear when, and for what purpose, these funds would be expended by the municipalities.
